  3. Follow up your phone call with a written Notice of Error via certified mail within 10 business days: Under 12 C.F.R. § 1005.11(b)(2), if you report an unauthorized electronic transfer by phone, the bank has the legal right to require written confirmation within 10 business days, and if you fail to send that written letter, the bank is legally excused from giving you a 10-day provisional cash credit while they investigate. Always send a signed written Regulation E Notice of Error (or Regulation Z Billing Error Notice) via certified mail and secure message immediately.
  4. Revoke recurring ACH debit authorizations using Both a Written Revocation and a Bank Stop-Payment Order: If a predatory lender, gym, subscription merchant, or biller refuses to stop pulling recurring ACH debits from your checking account, send a written revocation email to the merchant AND instruct your bank to place a formal Stop-Payment Order / ACH Revocation Block at least 3 business days before the next scheduled debit (12 C.F.R. § 1005.10©).
  5. File a police report and an FTC Identity Theft Report to defeat "friendly fraud" denials: Banks frequently reject Regulation E claims by claiming that you, a family member, or someone you gave your phone to made the transfer. Immediately file an online report at IdentityTheft.gov (generating a sworn federal FTC Identity Theft Report) and file a local police report (or call your local non-emergency police line; if you are in immediate physical danger from a robbery or extortion, call your local emergency number: 911 in the US and Canada, 112 in the EU, 999 in the UK, or check our အရေးပေါ်နံပါတ်များ). Attach both report numbers to your written bank dispute.
  6. Demand the bank's documentary investigative records if your claim is denied, and escalate to the CFPB: Under 12 C.F.R. § 1005.11(d)(1), if a bank denies your Regulation E claim and reverses your provisional credit, you have the absolute statutory right to demand free copies of all documents, IP logs, device IDs, and investigation notes the bank relied upon to deny your claim, and to file an immediate regulatory enforcement complaint with the Consumer Financial Protection Bureau (consumerfinance.gov/complaint)

Regulation E (Debit, ACH, P2P) vs. Regulation Z (Credit Cards): Statutory rights comparison

Understanding which statute governs your stolen or disputed money is critical because credit cards and bank account transfers operate under completely different federal laws, timelines, and merchant-dispute rules.

Legal Feature Regulation E (Electronic Fund Transfer Act / 12 C.F.R. Part 1005) Regulation Z (Truth in Lending & Fair Credit Billing Act / 12 C.F.R. Part 1026) NACHA Operating Rules / International Equivalents (Canada, UK, EU, Australia)
Transactions Covered Debit cards, ATM withdrawals, checking/savings ACH debits, online bill pay, and consumer P2P apps (Zelle, Venmo, Cash App, PayPal). Credit cards, charge cards, and open-end revolving lines of credit. US NACHA: Consumer ACH debit returns (R10 / R07)
Canada: Payments Canada Rule H1.
UK: Payment Services Regs / APP Fraud Reimbursement.
Australia: ePayments Code.
Whose Money Is Missing During the Dispute? Your actual cash is missing from your checking account until the bank issues a provisional credit. The bank's money is on hold; the bank must freeze collection of the disputed charge and related interest during the investigation. Your cash is missing until reimbursed (within 1 business day under UK PSR / EU PSD2, or upon filing WSUD under NACHA/Canada Rule H1).

  • Pass-Through Card Dispute: If you funded a Venmo, PayPal, or Cash App transaction using a linked credit card or debit card (rather than a direct bank balance) to buy goods that were never delivered or were fraudulent, file a Regulation Z / Card Network Chargeback directly with the card-issuing bank.
  • Bank Failure to Block Flagged Fraudulent Recipient Accounts: As established in government enforcement lawsuits against major P2P operators, if the bank failed to act on prior fraud reports against the recipient account or failed to implement reasonable security procedures, escalate immediately to the CFPB and your State Attorney General.

3. Stopping Unauthorized or Revoked ACH Debits (NACHA Return Codes R10 နှင့် R07)

When a company pulls money directly out of your checking account via your routing and account number (ACH debit) without permission, or continues pulling money after you canceled your membership or payday loan automatic payment, you have dual protection under Regulation E (12 C.F.R. § 1005.10©) and NACHA Operating Rules:

  • Go into a branch or call your bank to sign a "Written Statement of Unauthorized Debit" (WSUD): Under NACHA rules, when you sign a WSUD within 60 calendar days of the statement date stating either that the debit was never authorized (Return Reason Code R10) or that you previously revoked the authorization with the merchant (Return Reason Code R07), your bank can automatically claw the money back from the merchant's bank through the ACH clearinghouse within 24 to 48 hours and recredit your checking account immediately.
  • Demand Refund of All Resulting Overdraft / NSF Fees: Under Regulation E, if an unauthorized EFT or a debit pulled after a valid stop-payment order drains your checking account and causes three other bills to bounce, the bank must refund not only the stolen transfer amount, but also 100 percent of all overdraft, NSF, and returned-item fees triggered by the unauthorized debit.

Winning Credit Card Chargebacks under Regulation Z (Fair Credit Billing Act)

Credit cards offer the strongest consumer dispute protections in the financial system. Under the Fair Credit Billing Act (FCBA, 15 U.S.C. § 1666 / Regulation Z, 12 C.F.R. § 1026.13), there are two distinct legal mechanisms on your credit card:

1. Statutory "Billing Errors" (12 C.F.R. § 1026.13): Strict 60-Day Written Deadline

Under Regulation Z, a statutory "Billing Error" includes not only unauthorized fraud charges by a stranger, but also:

  • Charges for goods or services you did not accept or that were not delivered as agreed (for example, a merchant sends the wrong item, delivers broken merchandise you refused/returned, or goes out of business before delivering your furniture or flight).
  • Charges with an incorrect dollar amount or duplicate double-billing.
  • Failure to post a return credit or refund that a merchant promised you.
  • Charges for which you request written clarification and documentary proof (such as a signed receipt).

Clicking 'Dispute' on a credit card website does NOT always trigger full FCBA legal rights

Under 12 C.F.R. § 1026.13(b), to trigger the full statutory protections of the Fair Credit Billing Act, including the legal prohibition on reporting you delinquent to credit bureaus and mandatory forfeiture of up to $50 if the bank violates the rules, you must send a written Billing Error Notice to the specific "Billing Inquiries / Disputes" address printed on your monthly credit card statement (not the payment lockbox address) so that it reaches the bank within 60 calendar days after the first statement showing the error was sent to you, unless the bank explicitly states on its portal that electronic submission preserves FCBA rights. Always mail a physical certified letter to the Billing Inquiries address in addition to filing online.

2. The Special "Claims and Defenses" Rule for Quality Disputes (12 C.F.R. § 1026.12©)

What if a merchant delivered the item or service, but it was defective, shoddy, or breached a warranty, and the merchant refuses to refund you? Under 12 C.F.R. § 1026.12© (15 U.S.C. § 1666i), you can legally withhold payment on your credit card and assert all legal claims and defenses against the credit card bank that you have against the merchant, provided:

  1. You first made a good-faith attempt to resolve the issue with the merchant (save your emails asking the merchant for a refund or repair);
  2. The purchase exceeded $50 and took place in your home state or within 160 kilometers (100 miles) of your mailing address (courts and card network rules generally treat online/telephone orders shipped to your home as occurring at your home address, and these geographic and $50 limits do not apply at all if the merchant is affiliated with the card issuer or solicited the order through an advertisement mailed/emailed via the card issuer); and
  3. The balance of that disputed charge had not yet been paid off at the time you first notified the bank or merchant of the dispute.

How to overturn a bank denial when your provisional credit is reversed

Frequently, a bank will issue a temporary provisional credit on Day 10, conduct a cursory 2-minute automated check confirming that the thief used your device ID or IP city, and send you a boilerplate denial letter on Day 44 stating: "We found no error occurred and will debit the provisional credit back out of your account in 5 business days."

Take these four escalation steps immediately to force a reversal:

  1. Enforce your 5-Business-Day Buffer before they debit back provisional funds: Under 12 C.F.R. § 1005.11(d)(2), when a bank revokes a provisional credit, it must give you written notice of the exact date and amount of the debit AND must continue to honor all checks, drafts, and third-party payments from your account without charging ANY overdraft fees for 5 full business days after sending the revocation notice (up to the amount of the provisional credit). Use those 5 business days to pay critical rent/utility bills or move unencumbered funds if needed.
  2. Serve a written Statutory Demand for All Investigative Documents (12 C.F.R. § 1005.11(d)(1)): Most banks fail to perform a genuine investigation. When you send a formal written request demanding all documents, IP address logs, device fingerprints, merchant contracts, and call recordings the bank relied upon to deny your claim, compliance attorneys inside the bank review the file and frequently reverse the denial rather than admit they lacked legally sufficient evidence.
  3. File a formal regulatory complaint with the CFPB (or Federal Reserve / OCC / NCUA): Go to consumerfinance.gov/complaint and submit a detailed complaint attaching your Regulation E letter, your FTC Identity Theft Report, your Police Report, and the bank's boilerplate denial. By law, large banks must respond in writing to the CFPB within 15 days through their Executive Regulatory Escalation Office (not the call center that denied you).
  4. Invoke Treble Damages and Mandatory Attorney's Fees (15 U.S.C. §§ 1693f(e) & 1693m): Under the Electronic Fund Transfer Act (15 U.S.C. § 1693f(e)), if a bank fails to provisionally recredit your account within the 10-day deadline, fails to conduct a good-faith investigation, or knowingly and willfully concludes that your account was not in error when such conclusion could not reasonably have been drawn from the evidence, the bank is liable to you in federal court for TREBLE DAMAGES (3x your actual damages) plus statutory damages ($100 to $1,000) plus 100 percent of your consumer attorney's legal fees and court costs. မေးလေ့ရှိသောမေးခွန်းများ

Can a bank legally refuse to refund me under Regulation E if a scammer tricked me into reading them a 2FA text code over the phone?

No. If an impostor tricked you into sharing a one-time passcode, password, or login credential and the scammer then used that code to log into your account and transfer money out, that transaction is legally an "unauthorized electronic fund transfer" under 12 C.F.R. § 1005.2(m). Both the plain text of Regulation E and official Consumer Financial Protection Bureau (CFPB) guidance state that access obtained through fraud or robbery is unauthorized, and under Official Interpretation 12 C.F.R. § 1005.6(b)-2, a bank is strictly prohibited from denying your claim or increasing your liability on the theory that you were "negligent" in falling for a phishing or impersonation scam.

How long does my bank have to put my stolen money back into my checking account while investigating?

Under federal Regulation E (12 C.F.R. § 1005.11(c)), once you report an unauthorized electronic transfer, your bank has 10 business days (or 20 business days if your checking account has been open for less than 30 days) to complete its investigation. If the bank needs more time, up to 45 calendar days for standard transfers, or up to 90 calendar days for point-of-sale debit card transactions, foreign transactions, or new accounts, the bank is legally required to deposit a "provisional credit" for the full disputed amount (minus at most $50) back into your checking account by the 10th business day so you have full use of your money while the bank finishes investigating. To preserve your right to that 10-day provisional credit, you must send written confirmation of your dispute within 10 business days if the bank requests it.

What is the difference between disputing a purchase on a debit card versus a credit card when a merchant scams me or sends broken goods?

When you voluntarily pay a merchant who then fails to deliver goods or sends defective merchandise, the transaction is "authorized" (since you intended to pay that merchant), so federal Regulation E's statutory unauthorized-transfer protections do not apply to a debit card. While Visa and Mastercard voluntary network chargeback rules still allow you to file a merchandise dispute on a debit card, your cash remains out of your checking account unless the bank grants a courtesy credit, and you lack the federal Fair Credit Billing Act "Claims and Defenses" right (12 C.F.R. § 1026.12(c)) that applies exclusively to credit cards. For that reason, always use a credit card rather than a debit card for online purchases, travel bookings, and deposits.

Can my bank close my checking account because I filed a Regulation E fraud dispute?

While deposit agreements generally allow banks to close accounts at will, a bank cannot close your account to evade its legal obligation to investigate and refund an unauthorized electronic transfer that occurred before closure. In addition, if a bank wrongfully denies your fraud claim, lets your account go negative, and then reports a negative unpaid balance to ChexSystems or Early Warning Services (EWS), blocking you from opening a checking account at another bank, you have the right to dispute that inaccurate reporting under the Fair Credit Reporting Act (FCRA) alongside your Regulation E claim.
