Find nummeret for dit land.
- Institute an immediate 100% "Litigation Hold" (Do NOT delete a single text, email, or file). The instant you receive or learn about a subpoena, you are under a strict legal duty to preserve all potentially relevant physical and digital evidence. Do not delete text message threads, clear your browser history, shred paper notes, or allow auto-delete settings on WhatsApp, Signal, Slack, or email to overwrite messages. Deleting or altering records after receiving a subpoena transforms a civil dispute into a felony Obstruction of Justice / Spoliation of Evidence charge.
- Record the exact date, time, and method of delivery. Write down on a separate sheet of paper (not on the original subpoena itself) the exact date and time you received the subpoena, whether it was handed to you in person or left in your mailbox/sent by email, and whether a Witness Fee and Mileage Check was attached. Improper service or missing witness fees are major procedural defenses.
- Calendar the TWO critical deadlines: the Compliance Date AND the 14-Day Objection Deadline. Under Federal Rule of Civil Procedure 45(d)(2)(B) (and parallel rules in most states), if a civil subpoena commands you to produce documents, electronically stored information, or tangible things, you must serve Written Objections on the issuing attorney within 14 calendar days after the subpoena is served (or before the compliance date stated on the subpoena, whichever is earlier). Missing the 14-day window can waive your right to object.
- Check if your employer, professional liability insurer, or homeowners policy provides a free lawyer. If the subpoena relates in any way to something you witnessed, wrote, or did at work, notify your employer's General Counsel / Legal Department or HR immediately; companies routinely provide their own corporate counsel to represent current and former employees at depositions free of charge. If it relates to your professional license (medical, nursing, therapy, accounting, real estate) or a personal accident, call your Malpractice / Professional Liability or Homeowners / Auto Insurance carrier immediately.
- Never call the issuing lawyer to "explain everything" off the record. Lawyers who issue subpoenas frequently tell witnesses: "Just give me a quick 10-minute phone call to tell me what you know, or email me those records today, and maybe I can cancel your deposition." Be careful: anything you tell the lawyer on the phone is unprivileged, can be used against you, and rarely gets you out of testifying if what you say helps their case. Keep all initial contact strictly focused on scheduling and procedural logistics, or have an attorney speak for you.
Never turn over third-party medical, patient, student, or employee records on a regular lawyer subpoena without checking privacy laws
In most jurisdictions, an attorney of record can sign and issue a civil subpoena without a judge ever looking at it. However, if a lawyer's subpoena demands patient medical or mental health records (HIPAA / 42 C.F.R. Part 2), student educational records (FERPA), consumer bank/credit records, or third-party employee personnel files, handing those records over without either a Signed Patient/Consumer Authorization, a Qualified Protective Order + Notice to the Individual, or a Judge-Signed Court Order can expose you to severe federal civil penalties and lawsuits for unlawful disclosure. Always serve a formal written objection citing statutory privacy restrictions first.

Identifying the 4 types of subpoenas and who signed them¶
Look closely at the title of the document, the court listed at the top, and the signature line at the bottom to determine what power stands behind the subpoena:
| Subpoena Type | What It Commands You to Do | Who Signs It & Key Rules |
|---|---|---|
| 1. Subpoena Ad Testificandum (Trial or Hearing Subpoena) | Commands you to appear in person (or by video) at a specific courthouse, courtroom, date, and time to give live sworn testimony before a judge or jury. | Signed by the Clerk of Court or an Attorney of Record as an officer of the court. Must include statutory 1-day Witness Fee + round-trip mileage upfront in most civil cases. |
| 2. Deposition Subpoena | Commands you to appear at a lawyer's office, court reporter's suite, or Zoom link before trial to answer questions under oath recorded by a stenographer/videographer. | Signed by an Attorney of Record. Unlike a courtroom trial, the date and location of a deposition are chosen unilaterally by the lawyer and can almost always be renegotiated in writing. |
| 3. Subpoena Duces Tecum (Records / Document Subpoena) | Commands you (or a Custodian of Records) to produce copies of specified documents, electronic files, photos, texts, or financial records by a deadline, often without appearing in person. | Check the box on the form: if the box for "Appearance NOT required if records are produced with a Custodian Affidavit" is checked, mailing the records (or serving timely Written Objections) satisfies the subpoena. |
| 4. Grand Jury or Administrative Investigative Subpoena | Commands testimony or records for a secret Criminal Grand Jury (signed by a Prosecutor/AUSA) or government agency investigation (DOJ, SEC, FTC, DOL, IRS, State AG). | Governed by criminal/administrative rules rather than civil Rule 45. Never respond to a Grand Jury or regulatory subpoena without consulting a defense attorney first. |
5 procedural defects that make a civil subpoena invalid or unenforceable¶
Before you spend time or money complying with a burdensome civil subpoena, check whether the issuing lawyer violated any of these five mandatory procedural rules under Federal Rule of Civil Procedure 45 (and analogous state statutes):

(Motion to Quash vs. Negotiation)¶
- For a Deposition: Lawyers pick an arbitrary date when they type up a deposition subpoena. If you have work, childcare, medical, or travel conflicts, email the lawyer immediately offering 3 alternative dates 2 to 4 weeks out, and ask them to stipulate in writing to conduct the deposition via Zoom / Remote Video so you do not have to travel. Always get any date change or cancellation in writing (email confirmation), never rely on a verbal promise that a deposition was postponed.
- For a Courtroom Trial: Trial subpoenas always list "Day 1 of Trial at 9:00 AM," even though the lawyer may not actually call you to the witness stand until Thursday afternoon. Email the lawyer and ask to be placed on "On-Call / Standby Agreement", where you confirm in writing that you are excused from sitting in the courthouse hallway on Day 1 and agree to appear at the courthouse within 2 to 4 hours of receiving a phone call or text when your turn to testify actually arrives.
- When you must file a formal "Motion to Quash or Modify Subpoena" (Rule 45(d)(3)): If the issuing lawyer refuses to reschedule an impossible deposition date, demands testimony violating the 100-mile rule, or seeks privileged testimony (such as a journalist's source, a therapist's patient session, a spouse's confidential marital communications, or a criminal target's Fifth Amendment privilege), you must file a Motion to Quash Subpoena and/or Motion for Protective Order with the court before the scheduled date of testimony.
Surviving a Deposition or Court Testimony: 7 Golden Rules for Witnesses¶
If you do appear for a deposition or trial testimony, follow these seven courtroom rules used by trial lawyers to protect witnesses from traps:
- Tell the absolute 100% truth (Perjury is a felony, while bad facts rarely hurt a non-party): Never exaggerate, shade the truth, or guess to help a friend or employer. Lying under oath about a material fact is felony Perjury (18 U.S.C. Section 1621).
- Listen to the entire question, pause 2 full seconds, and answer ONLY the exact question asked: Do not volunteer extra background stories, explanations, or theories. If the lawyer asks, "Do you know what time the meeting started?" the truthful answer is simply "Yes" or "No", not a 5-minute speech about what happened at the meeting. Pausing two seconds before speaking also gives any lawyer in the room time to state an Objection on the record.
- "I don't know" and "I don't recall" are completely valid, truthful answers: Never guess, speculate, or estimate distances, speeds, dates, or exact conversations if you are not sure. If you do not remember whether an email was sent in March or April, say clearly: "I do not recall the exact date without looking at the document."
- Never comment on a document until the lawyer hands it to you and you read the whole page: If a deposing lawyer asks, "Didn't you write in your June 12 email that the brakes were broken?" reply calmly: "Please show me the June 12 email you are referring to so I can read it in context before answering."
- Beware of the "Did you talk to anyone to prepare for today?" trap: Opposing lawyers always ask who you spoke with and what documents you reviewed to prepare for your deposition. Why? Under Federal Rule of Evidence 612, if you review a specific private notebook or document to refresh your memory for your testimony, the opposing lawyer can demand to see and copy that document (unless it is protected attorney-client communication). Never bring personal notes, diaries, or phones to the witness stand unless the subpoena specifically ordered them produced.
- Know when to invoke your Fifth Amendment Privilege against Self-Incrimination: Even in a civil lawsuit, divorce case, or administrative deposition, you retain your absolute constitutional Fifth Amendment right to refuse to answer any question where a truthful answer could provide a "link in the chain of evidence" tending to incriminate you in any federal or state crime (such as tax fraud, unlicensed activity, drug possession, assault, or PPP/unemployment fraud). Unlike a criminal defendant (who can refuse to take the witness stand at all), a subpoenaed civil witness must sit down, state their name, listen to each individual question, and invoke the privilege question-by-question: "On the advice of counsel, I respectfully invoke my Fifth Amendment privilege against self-incrimination and decline to answer."
- Can your employer fire you for missing work to obey a subpoena? In the vast majority of US states, Canada, the UK, and Australia, it is strictly illegal under state witness-protection and public-policy statutes for an employer to fire, demote, discipline, or threaten an employee for taking time off work to comply with a valid court or deposition subpoena (especially a criminal, domestic violence, or third-party court summons), provided you give your employer advance copies of the subpoena as soon as you receive it.
Global rules for Witness Summonses and Subpoenas (UK, Canada, Australia)¶
- Canada (Summons to Witness / Subpoena under Provincial Rules & Criminal Code): In Canadian civil actions (such as Rule 53.04 / Rule 34.04 of the Ontario Rules of Civil Procedure), a Summons to Witness (Form 53A) is completely invalid and cannot be enforced by a bench warrant unless the server personally hands you the summons together with the mandatory statutory Attendance Money (calculated under Tariff A: typically 50 CAD per day plus travel allowance). If a summons is abusive, oppressive, or seeks irrelevant records from a non-party, you can bring a motion to quash the summons. In Canadian criminal cases (Criminal Code Section 698 to 708), a Subpoena requires no attendance money for local witnesses and carries a Material Witness Warrant if ignored.
- Australia (Subpoena to Attend to Give Evidence / Subpoena to Produce): Under the Uniform Civil Procedure Rules (UCPR Part 33) and Federal Court Rules across Australia, a subpoena has no legal effect unless it is served on or before the "Last Day for Service" printed explicitly on the face of the subpoena, AND the issuing party tenders Conduct Money sufficient to meet your reasonable travel and accommodation expenses. In addition, for a Subpoena to Produce Documents, the issuing party is legally obligated under UCPR Rule 33.11 to pay a non-party's reasonable loss or expense incurred in complying with the subpoena (including staff time, IT searches, photocopy fees, and legal advice on privilege). You can apply to the Registrar or Court to set aside the subpoena in whole or in part if it is a "fishing expedition," oppressive, or an abuse of process.
Ofte stillede spørgsmål¶
If a process server tries to hand me a subpoena and I refuse to touch it or let it fall to the ground at my feet, am I legally served?
Yes. Under well-settled state and federal case law on **Personal Service of Process**, once a process server identifies you in person, informs you that they have legal papers/a subpoena for you, and attempts to hand them to you, you **cannot defeat service by refusing to take the papers in your hand, slamming the door in their face, or walking away**. In that situation, the process server is legally permitted to drop the subpoena on the ground at your feet, place it on your car windshield, or leave it on your doorstep ("Drop Service"), sign the Affidavit of Personal Service, and the judge will treat you as **100 percent validly served**, Except now you won't even know the compliance deadline or courtroom if you left the papers in the street. Always take the document calmly and examine it.
Is a subpoena that arrived in my regular mailbox or by email legally valid if I never signed for it?
It depends on the court and type of case. In **United States Federal Court (FRCP Rule 45)** and the majority of states, a civil subpoena to a non-party requires **in-person delivery**, so an unconsented email or regular first-class mail subpoena is technically defective and cannot support a contempt arrest on its own. **However**, several states (such as New Jersey, Virginia, and certain administrative/traffic or criminal misdemeanor courts) explicitly permit service of witness subpoenas by **Certified Mail, Sheriff's Mail, or even regular mail followed by phone confirmation**. Even if a mailed subpoena has defective service, **never simply throw it in the trash**, either send a formal written Rule 45 Objection noting the defective service, or have a lawyer confirm whether the court recognizes mail service in that jurisdiction.
Can I demand that the lawyer who subpoenaed my records pay me for my time and copying costs before I hand anything over?
Yes, if you are a **non-party** to the lawsuit. Under **Federal Rule of Civil Procedure 45(d)(1) and 45(d)(2)(B)(ii)**, the issuing attorney has an affirmative legal duty to *"take reasonable steps to avoid imposing undue burden or expense on a person subject to the subpoena,"* and courts are **required** to protect a non-party from any "significant expense resulting from compliance." Similarly, many state statutes (such as California Evidence Code Section 1563, which sets strict statutory per-page copying fees and hourly clerical time rates for business records) allow a non-party custodian to demand an itemized reimbursement fee. To preserve your right to cost reimbursement, you **must serve a timely Written Objection within 14 days** stating your estimated compliance cost and demanding a written cost-reimbursement agreement **before** you incur the expense.
What happens if I have a pre-paid vacation, surgery, or critical work trip on the exact date the subpoena orders me to appear?
Do not panic, and never skip your surgery or forfeit non-refundable travel before talking to the issuing lawyer. In **95 percent of depositions and hearings**, the attorney who issued the subpoena had no idea about your schedule when they picked that date. Immediately email the issuing attorney attaching proof of your pre-booked flight itinerary, hotel reservation, or doctor's surgical schedule, and offer **3 alternative dates** before or after your trip (or offer to testify via remote Zoom video). If the subpoena is for a fixed courtroom trial date that cannot move, ask the lawyer to schedule a **Video Preservation Deposition (De Bene Esse Deposition)** before your trip or ask the judge for permission to testify live by courtroom video link (**FRCP Rule 43(a)**).
