SANE / SAFE
- You control every single step of the exam: A forensic medical exam is never an "all-or-nothing" procedure. You have the absolute right to consent to treatment for injuries and STI/pregnancy medications while declining a pelvic swab, or to pause or stop the exam at any second for any reason.
- Anonymous / Non-Report Forensic Kits ("Jane Doe" or "John Doe" Kits): Under the federal Violence Against Women Act (VAWA) and the Survivors' Bill of Rights Act in the United States (as well as NHS SARC and Canadian "Third Option" protocols), adult survivors have the legal right to undergo a full forensic SANE exam completely free of charge and have the evidence kit stored under an anonymous tracking code without notifying or speaking to police. Depending on state law, the state crime lab or hospital must preserve your anonymous kit for at least 1 to 20 years (and cannot destroy it without notifying you first), giving you months or years to heal and decide later whether you want to convert the kit into an active report.
- Protecting privacy on a parent health insurance policy: Under VAWA, hospitals are forbidden from billing a survivor or requiring them to use private health insurance for the forensic exam itself. However, if the hospital bills your parents' private health insurance plan for additional prescription drugs, radiology scans, or emergency room facility fees, an Explanation of Benefits (EOB) statement listing diagnostic codes could be mailed to your parents' home address. Explicitly tell the hospital registration clerk and SANE nurse: "I am on my parents' insurance and need to suppress EOB mailings or apply direct state Crime Victims Compensation / VAWA funds so nothing is billed to my family insurance."
Phase 2: Confidential Resources vs. Mandatory Reporters ("Responsible Employees")¶
One of the most common and distressing shocks for college students occurs when they confide in a trusted Resident Advisor (RA), academic advisor, athletic coach, or favorite professor thinking it is a private conversation, only to receive an official email from the university Title IX Office the next morning stating that a file has been opened in their name.
Who can keep a secret on campus, and who is legally required to report¶
Universities divide campus personnel into two strict legal categories under Title IX guidance and state campus safety statutes:
| Campus Role / Resource Category | Reporting Status | What They Must Report to the University Title IX Office | Best Used When You Want To... |
|---|---|---|---|
| Talk through what happened in complete safety, get emotional support, understand campus procedures, or arrange academic extensions without triggering an institutional report. |
| 2. Mandatory Reporters ("Responsible Employees") • Resident Advisors (RAs) & Residence Hall Directors • Professors, Deans, & Teaching Assistants (TAs) • Athletic Coaches & Trainers • Fraternity/Sorority Life Advisors & Campus Security Authorities |
Mandatory Reporter to Title IX Office | Everything you tell them. Within 24 to 48 hours of learning about an incident of sexual assault, dating violence, or stalking, they are required by university policy to file an online report with the Title IX Coordinator listing your name, the accused student name, dates, and locations. | Formally put the university on notice, request an immediate dorm room move through housing, or initiate a formal Title IX inquiry. |
| 3. Title IX Coordinator / Sexual Misconduct Office | Institutional Compliance & Supportive Measures Officer | Receives all Mandatory Reports. Reaches out to the survivor by email to offer Supportive Measures and explain the option to file a Formal Complaint. Generally respects a survivor decision not to pursue a formal investigation unless there is an extreme, ongoing threat to campus safety (such as a serial weapon offender). | Obtain enforceable No-Contact Orders, emergency dorm changes, schedule adjustments, or launch a formal disciplinary investigation/hearing. |
| 4. Campus Police / Municipal Law Enforcement | Criminal Law Enforcement | Investigates criminal offenses under state/national penal codes (separate from the university student code of conduct). Note: Under the federal Clery Act, non-police "Campus Security Authorities" submit anonymous statistical headcounts for the annual crime log without releasing victim names. | Seek a civil/criminal Restraining Order (Order of Protection), execute search warrants, or press criminal felony/misdemeanor charges. |
How to stop a Resident Advisor or Professor before you disclose
If you walk into a professor office or knock on your Resident Advisor dorm door because you need help missing an exam or unlocking a room, you do not have to describe the sexual assault to get help. Simply ask first: "Are you a confidential resource or a mandatory Title IX reporter?" If they confirm they are a mandatory reporter, you can say: "I am dealing with an acute personal medical emergency and I am working with the Campus Survivor Advocate / Counseling Center, who will send you a verification note for my exam extension."
Phase 3: Campus Drug and Alcohol Amnesty Policies¶
Assailants frequently target students who have been drinking alcohol at off-campus fraternity parties, bars, or dorm gatherings, or who have consumed cannabis or other recreational substances, and then weaponize the survivor fear of getting suspended for underage drinking to keep them silent.
How Medical and Title IX Amnesty protects survivors and witnesses¶
Almost every college and university in the United States, Canada, the United Kingdom, and Australia enforces a Sexual Misconduct and Medical Amnesty Policy (also mandated by state laws in states like New York ["Enough is Enough" Law], California, Virginia, and Texas):
- Protection for the Survivor: A student who reports experiencing sexual assault, dating violence, domestic violence, or stalking, or who seeks emergency medical care after an assault, will not face university student conduct disciplinary charges, probation, suspension, or parental alcohol notifications for personal consumption of alcohol (including underage drinking) or recreational drugs at or near the time of the incident.
- Never withhold drinking details from SANE nurses or investigators: Do not hide the fact that you drank alcohol or voluntarily took a substance before the assault. Under every criminal statute and university consent policy (
Affirmative Consent/"Yes Means Yes"standards), incapacitation by alcohol or drugs negates the capacity to give consent. Attempting to conceal alcohol consumption out of embarrassment weakens the evidence proving that you were incapacitated or that your drink was spiked.
Phase 4: Immediate Supportive Measures (Without Filing a Formal Complaint)¶
A widespread misconception among students is that you must file a formal Title IX lawsuit or go through a traumatic adversarial hearing against the perpetrator before the university will move you out of a shared dormitory or tell the perpetrator to stay away from you.
Under United States federal Title IX regulations (34 CFR Part 106), the Violence Against Women Act (VAWA) amendments to the Clery Act, UK Office for Students (OfS) Condition E6, and Canadian provincial Campus Sexual Violence Policies, colleges are legally required to provide Supportive Measures (also called Interim Accommodations) immediately upon request:
- Free, non-disciplinary, and available WITH or WITHOUT a formal complaint: You can walk into the Title IX Office (or have your Confidential Survivor Advocate make the request on your behalf) and receive binding supportive measures even if you explicitly state that you do not want a formal investigation, disciplinary hearing, or police report.
The 6 core campus supportive measures you can request today¶
- Campus No-Contact Orders (NCOs) / No-Contact Directives:
- Issued by the Title IX Coordinator or Dean of Students, prohibiting the respondent from contacting you in person, by phone, text, email, social media, or through third-party friends.
- If you share a campus building, dining hall, or library, the university can append a Time-and-Space Restriction Matrix (for example, designating specific hours when the respondent is barred from entering a particular dining commons or student recreation center).
- Note on Mutual vs. Unilateral No-Contact Orders: Universities often issue "mutual" No-Contact Orders by default so neither counts as a pre-hearing disciplinary sanction; however, you can request a unilateral directive or campus boundary restrictions if safety requires it, and if a respondent violates a campus NCO, they face immediate disciplinary charges for Failure to Comply.
- Emergency Housing and Dormitory Relocations:
- If the perpetrator lives on your dorm floor, in your suite, or holds a guest pass to your residence hall, the university must immediately offer safe alternative housing:
- Moving you to a temporary confidential "safe room" on campus for 24 to 72 hours while permanent keys are cut;
- Permanently transferring you to a different residence hall at no extra room-rate cost (and providing campus maintenance assistance to move your belongings privately);
- Banning the respondent from entering your residence hall building entirely; or
- Executing an Emergency Removal of the respondent from campus housing if an individualized safety and risk analysis determines they pose an immediate threat to physical health or safety.
- Academic Accommodations and Retroactive Relief:
- The Title IX Coordinator or Survivor Advocate notifies your professors that you require academic adjustments without disclosing to the professor that you were sexually assaulted (professors are simply told the Title IX / Dean of Students Office has verified an acute circumstance).
- Accommodations include: excused absences, deadline extensions on papers and problem sets, rescheduling midterms or final exams, taking exams in a separate private testing room, switching to an alternate lecture or lab section so you do not sit in the same room as the perpetrator, Late Drop / Withdrawal (
W) without academic penalty, Incomplete (I) grades with extended completion timelines, and protection of financial aid / scholarship Satisfactory Academic Progress (SAP) standing. - Campus Employment and Extracurricular Schedule Adjustments:
- Reassigning work-study shifts, dining hall schedules, research lab rotations, or student organization leadership workspaces so you never work the same shift or report to the same supervisor as the respondent.
- 24/7 Campus Safety Escorts and Building Access Locks:
- Providing point-to-point night safety van/walking escorts between classes and dorms, recoding electronic keycard locks on your dorm suite, and flagging your campus ID profile so front-desk security guards block the respondent from signing into your building.
- Visa and Immigration Protection for International Students:
- If trauma requires an international student on an
J-1visa (or UK Student Visa / Canadian Study Permit) to drop below a full-time course load, the campus Designated School Official (DSO) and health center can authorize a Medical Reduced Course Load (RCL) so the student maintains lawful immigration status without risking deportation.
Phase 5: Preserving digital evidence for Title IX or police investigations¶
Most campus sexual assaults involve critical digital evidence created in the hours before and after the event: party invitations, text messages demonstrating severe intoxication (typos, slurred voice notes, friends texting "Are you okay? You could barely stand"), location-sharing pins, and post-assault admissions or apologies sent by the perpetrator on disappearing-message platforms like Snapchat or Instagram Vanish Mode.
How to preserve forensic-grade digital evidence before it disappears¶
- Defeat disappearing messages with a second camera or screen recording:
- On platforms like Snapchat, taking a native screenshot sends an instant alert to the perpetrator, prompting them to block you or delete their account. If you need to capture a Snapchat message quietly, use a trusted friend phone to film a clear video of your screen showing you opening the message and tapping on the sender profile header to prove their exact username.
- For iMessage, WhatsApp, and Instagram DMs, take both static screenshots and a continuous screen recording where you scroll through the conversation thread and tap the contact name at the top of the screen to reveal the underlying 10-digit telephone number or unique account handle (this defeats claims that a contact name was faked).
- Download ride-share, keycard, and financial timestamps:
- Save PDF receipts from Uber or Lyft showing the exact pickup and drop-off addresses and minute-by-minute timestamps.
- Save Venmo, CashApp, or Apple Pay histories, bar tabs, and Ask the Title IX Office or Campus Police to immediately put a litigation preservation hold on residence hall electronic keycard swipe logs and hallway CCTV security cameras (many dorm cameras overwrite video footage every 7 to 14 days).
- Write a dated contemporaneous memo and list of witnesses:

- Strict Prohibition on Retaliation: It is a separate, severe violation of federal law and university policy for the respondent, their fraternity/sorority friends, teammates, or faculty members to intimidate, harass, ostracize, or retaliate against you or your witnesses for requesting supportive measures or filing a complaint.
- Criminal Law Enforcement Report (Campus Police or Municipal Police SVU):
- Purpose: Criminal investigation and prosecution by the District Attorney / Crown Prosecution Service, which can also issue court-enforced Civil/Criminal Restraining Orders (Orders of Protection) where violation results in immediate arrest and jail.
- Department of Education Office for Civil Rights (OCR) / External Complaints:
- If your college or university mishandles your report, refuses to provide supportive measures, shows deliberate indifference, or retaliates against you, you can file a federal civil rights complaint directly with the U.S. Department of Education Office for Civil Rights (OCR) (or the Office of the Independent Adjudicator [OIA] in the UK, or provincial human rights tribunals in Canada).
If I already took a shower and washed my clothes after the assault, is it too late to go to the hospital for a SANE exam?
No, you should still go to a SANE-designated hospital or Sexual Assault Referral Centre (SARC) immediately. While showering washes away some surface evidence, trained Sexual Assault Nurse Examiners can still recover viable forensic DNA from internal swabs or skin crevices up to 72 to 120 hours (3 to 5 days) after an assault, and clothing that has not been washed yet (or bedsheets from the room) can still be tested. Even more importantly, the SANE exam provides critical, free medical care: HIV post-exposure prophylaxis (which must start within 72 hours), emergency contraception (up to 120 hours), STI treatment, and evaluation for internal injuries.
Can I get a forensic rape kit collected at the hospital without the police being called or an investigation starting?
Yes. Under the federal Violence Against Women Act (VAWA) in the United States, NHS SARC protocols in the United Kingdom, and "Third Option" forensic protocols across Canada, adult survivors have the absolute legal right to receive a free forensic medical exam and have their evidence kit stored anonymously under a code number ("Jane Doe" or "John Doe" kit) without filing a police report or speaking to law enforcement. The state or hospital preserves the sealed kit so that if you decide months or years later that you want to press charges, the physical DNA evidence is waiting for you.
Who on campus can I talk to without my name being reported to the Title IX Office?
To keep your conversation 100 percent confidential, speak only with designated Confidential Resources: Campus Sexual Assault Survivor Advocates, licensed therapists at Counseling and Psychological Services (CAPS), clinicians at the Student Health Center, ordained campus chaplains, or off-campus rape crisis hotlines. Do not disclose details of an assault to a Resident Advisor (RA), professor, teaching assistant, academic advisor, dean, or athletic coach unless you want the Title IX Office notified, almost all faculty, housing staff, and coaches are designated "Responsible Employees" (Mandatory Reporters) who are required by university policy to report your name to the Title IX Coordinator within 24 hours.
Will I get suspended or kicked out of campus housing if I was drinking alcohol underage or using drugs when the assault happened?
No. Almost every college and university, backed by state laws across the country, enforces a strict Sexual Misconduct Amnesty Policy. Under amnesty rules, neither a survivor nor a witness who reports sexual assault, dating violence, or stalking (or seeks medical assistance) will be disciplined under the student code of conduct for personal underage drinking or recreational drug use at or near the time of the incident. Never hide alcohol or drug consumption from medical staff or investigators, because incapacitation directly establishes that you could not legally give consent.
Do I have to file a formal Title IX complaint and go through a hearing just to get moved out of my dorm or get a No-Contact Order?
No. Under federal Title IX regulations (34 CFR 106.44) and the Clery Act, universities are legally required to offer and implement individualized Supportive Measures, including an emergency dorm room transfer, a campus No-Contact Directive, switching class sections, and exam deadline extensions, completely free of charge and without requiring you to file a formal disciplinary complaint or participate in an investigation.
What should I do if I wake up suspecting that someone slipped a roofie or date-rape drug into my drink last night?
Go to a hospital emergency department or SANE clinic immediately and explicitly ask for a Drug-Facilitated Sexual Assault (DFSA) forensic blood and urine toxicology screen, not just a standard hospital emergency room drug screen (which only checks for common street drugs and misses GHB, Rohypnol, and ketamine). Because drugs like GHB leave the body within 12 to 24 hours, time is critical; if you have to urinate before you can get to the hospital, catch your very first urination of the morning in a clean glass jar with a lid, place it in your refrigerator, and bring it with you to tell the SANE nurse the exact time it was collected.
