Busca o número do teu país.

| Vostede (o inquilino principal) é 100 % responsable ante o propietario principal. O subinquilino non ten ningunha responsabilidade contractual co propietario principal; deben aluguer legalmente a ti. | Si.

CRITICAL RULES FOR THE ROOMMATE RELEASE & SUBSTITUTION ADDENDUM
========================================================================
A proper Roommate Substitution Addendum must be signed by ALL FOUR parties:
(1) The Landlord, (2) You (Remaining Tenant), (3) Departing Roommate,
and (4) Incoming Replacement Roommate.
1. SECURITY DEPOSIT TRANSFER: Do NOT ask the landlord to split the
security deposit mid-lease (almost all landlords refuse). Instead,
specify in the Addendum that the Incoming Roommate pays their share
of the Security Deposit directly to the Departing Roommate (minus
any unpaid rent/utilities or bedroom damage owed by the Departing
Roommate), and the Departing Roommate permanently assigns 100% of
their legal claim in the Landlord-held deposit to the Incoming
Roommate.
2. CONDITIONAL RELEASE: If the Departing Roommate owes you $1,500 in
back rent, do NOT sign a general release waiving claims between
co-tenants. State explicitly: "Landlord releases Departing Tenant
from future rent obligations accruing after [Date], but nothing in
this Addendum waives Remaining Tenant's right to recover pre-existing
unpaid rent and utility obligations from Departing Tenant."
========================================================================
In over 42 U.S. states and Washington, D.C. (as well as every Canadian province and Australian state), residential landlords are governed by a strict statutory or common-law Duty to Mitigate Damages (for example, California Civil Code Section 1951.2, Texas Property Code Section 91.006, New York Real Property Law Section 227-e, Illinois 735 ILCS 5/9-213.1, and Ontario RTA Section 16).
- What the Duty to Mitigate means: Even if you have 8 months remaining on a fixed-term lease and are forced to surrender the apartment early because your roommate abandoned you, the landlord cannot leave the apartment sitting empty for 8 months and sue you for 8 months of rent. Once you return the keys and vacate, the landlord is legally required to make reasonable, good-faith commercial efforts to re-advertise and re-rent the apartment at a fair market rate just as they would any other vacant unit.
- Double-Dipping is Illegal: The exact day a new tenant's lease begins, your obligation (and your departed roommate's obligation) to pay future rent under the broken lease terminates by operation of law. A landlord is strictly prohibited from collecting double rent for the same apartment.
- How to protect yourself if the landlord tries to sabotage mitigation: On the day you turn in your keys, check real estate listing sites (Zillow, Apartments.com, the building's website) every week and take screenshots. If the landlord fails to list your unit for 90 days, or lists your $2,000/month unit at an inflated $2,900/month to deter applicants while renovators use it for storage, your screenshots prove the landlord breached their statutory duty to mitigate, wiping out their claim for post-move-out rent.
Step 2: Proactively market the entire unit to present a "Turnkey Replacement Household"¶
Before vacating, tell your landlord in writing: "Because my co-tenant defaulted and abandoned the lease, I must vacate and surrender possession on [Date] so you can mitigate damages. To minimize any vacancy gap to zero days, I am advertising the apartment now and will refer qualified applicants with 3x income and 700+ credit directly to your leasing office." If you hand the landlord two creditworthy applicants willing to sign a new lease starting the day after you move out and the landlord rejects them without a valid screening reason, the landlord forfeits their claim to lost rent in Mitigation states.
Step 3: Negotiate a Fixed "Early Termination Buyout Agreement" (with a Joint Release)¶
Many corporate property managers will agree to a clean Early Lease Termination Addendum in exchange for a fixed buyout fee (typically equal to 1 to 2 months' rent, or forfeiture of the security deposit) provided you leave the apartment broom-clean, undamaged, and surrendered by a set date.
- Watch out for unlawful "Liquidated Damages" penalties: In several states (such as California under Civil Code Section 1671, or Florida under Fla. Stat. Section 83.595 where lease buyout fees are strictly capped at a maximum of 2 months' rent and only if the tenant actively opted into the addendum at lease signing), a lease clause demanding an automatic "3-month penalty fee PLUS forfeiting your security deposit PLUS rent until re-let" is an illegal, unenforceable penalty clause.
- Keep your right to sue the vanished roommate for 50% (or 100%) of the Lease Buyout Fee: If you have to pay a $2,500 early termination fee to save your credit because your roommate abandoned the lease without warning, their breach of the co-tenancy contract caused that consequential damage, and you can include their share (or the full buyout fee if their breach exclusively forced the termination) in your Small Claims lawsuit against them.
Phase 3: Statutory emergency lease exits (Domestic violence, military, habitability)¶
| Statutory Exit Category | Governing Laws & Jurisdictions | Required Documentation & Notice Period | Financial & Deposit Impact |
|---|---|---|---|
| 1. Domestic Violence, Sexual Assault, Stalking, or Co-Tenant Abuse | Enacted in almost all 50 U.S. states (e.g., Cal. Civ. Code Section 1946.7; NY RPL Section 227-c; Tex. Prop. Code Section 92.016; WA RCW 59.18.575), Federal VAWA (for subsidized housing), and Canadian Provinces (e.g., Ontario RTA Section 47.1 using Form N15; BC RTA Section 45.1). | Written notice to landlord (typically 14 to 30 days' notice) accompanied by ONE of the following: (a) a Temporary Restraining Order / Protective Order, (b) a Police Report created within the last 60 to 180 days, OR © a signed certification from a qualified third-party professional (physician, RN, licensed counselor, or domestic violence shelter advocate). | Zero early-termination fee. You are only liable for prorated rent through the statutory notice date (14 to 30 days) and are permanently released from the lease thereafter, even if the other roommate stays behind. |
| 2. Statutory Lock-Change / "Kick-Out" Right Against an Abusive Co-Tenant | Available in numerous states (e.g., Cal. Civ. Code Section 1941.6, WA RCW 59.18.580, OR ORS 90.459, TX Prop. Code Section 92.0161). | If the abuser is your co-tenant on the lease, obtaining a court-issued Restraining Order / Order of Protection containing a "Move-Out / Residence Exclusion Order" forces the landlord (within 24 hours of request) to change the locks and give keys ONLY to you, barring the abusive co-tenant from the property while keeping them financially liable on the lease. | You stay safely in your home; the excluded abusive roommate remains legally liable for their share of the rent under most state statutes. |
| 3. Military Deployment or PCS Orders (SCRA) | Federal Servicemembers Civil Relief Act (SCRA), 50 U.S.C. Section 3955 (United States). | Written notice to the landlord plus a copy of Permanent Change of Station (PCS) orders or deployment orders for 90 days or more. Termination takes effect 30 days after the next rent payment is due. | Zero early-termination penalty by federal law; applies to the servicemember and their dependents. |
| 4. Uninhabitable Premises / Constructive Eviction | State Implied Warranty of Habitability statutes (all U.S. states except limited rural exceptions; UK Homes (Fitness for Human Habitation) Act 2018; Canadian provincial RTAs). | If the apartment lacks heat, running water, electricity, safe structure, or has raw sewage / toxic mold and the landlord fails to repair after formal written notice and code enforcement inspection. See Vivenda inhabitable e servizos esenciais. | Entitles all tenants to terminate the lease for Constructive Eviction without penalty and demand full return of the security deposit. |
Phase 4: How to legally handle a vanished roommate's abandoned belongings¶
When a roommate disappears in the middle of the night owing $2,000 in rent, they frequently leave behind a mattress, television, clothing, computers, or bicycles in their bedroom. Two catastrophic traps await the remaining roommate here:
- Trap 1 (Selling or trashing their items): You cannot hold a roommate's laptop, guitar, or clothing "hostage" as collateral for unpaid rent (claiming a "landlord's lien" on personal household property is illegal in almost every jurisdiction), nor can you sell their belongings on Facebook Marketplace or throw them in a dumpster without following statutory abandoned-property notice procedures. If you throw out a roommate's bags without notice, they can reappear 3 weeks later and claim their closet contained a $5,000 watch or $3,000 in cash, suing you for Civil Conversion.
- Trap 2 (Leaving the bedroom unusable for months): You need that bedroom cleared immediately so a paying replacement roommate can move in on the 1st of next month.
The 5-step legally bulletproof Abandoned Property protocol¶
- Conduct a Two-Person Video Inventory: With an impartial witness holding a smartphone camera recording continuous video, walk into the abandoned bedroom and film every single item left behind. Open drawers and closet doors on camera to prove there is no cash, jewelry, or high-value electronics hidden inside, and create a numbered written inventory list.
- Check the Estimated Resale Value Against Your State's Statutory Threshold: Most state abandoned-property statutes (for example, California Civil Code Section 1980 et seq.) divide abandoned tenant property into two tiers based on its total "reasonable resale/garage-sale value" (often $700 in California, or $500 to $1,000 in other states):
- If the total resale value of the left-behind junk is below the statutory threshold (under $700 in CA), once the statutory notice period expires, the property may be kept, donated, or disposed of without a public auction.
- If the total resale value is above the statutory threshold, the law often requires a noticed sale or turning it over to the landlord's statutory process.
- State clearly that you cannot withhold their belongings over unpaid rent. Under state law, you may only charge the actual, reasonable out-of-pocket cost of moving and storing the items (such as a $75/month U-Haul storage locker), NOT the $1,500 in back rent they owe you.
- Pack and Move the Items Into Secure Storage So You Can Re-Rent the Bedroom: You do not have to leave the vanished roommate's furniture spread across the bedroom floor during the 18-to-30-day notice period. After filming the inventory, carefully pack their belongings into labeled boxes and either stack them in a locked garage/hall closet or rent a small climate-controlled self-storage unit for one month so your new paying replacement roommate can move into the bedroom immediately.
- Have the Roommate Sign a Receipt Upon Pickup (or Photograph Disposal After the Deadline): If they return to pick up their boxes, meet them with a witness present, hand over all boxes at the curb or storage unit, and have them sign an itemized receipt confirming they received all of their possessions in good condition.
Phase 5: Suing your ex-roommate in Small Claims Court for unpaid rent and utilities¶
Once the immediate housing crisis is stabilized, either because you replaced the roommate, finished the lease, or paid a buyout to exit, you have a rock-solid legal claim to recover every dollar you were forced to cover on the defaulting roommate's behalf. This legal cause of action is called Equitable Contribution (under Joint and Several Liability law) and Breach of Contract / Implied Co-Tenancy Agreement.
What you can recover in a Roommate Small Claims lawsuit¶
When one co-tenant on a joint lease pays more than their proportionate share of the joint obligation to prevent default, they have an automatic legal right of contribution against the non-paying co-tenant for:
- Unpaid Base Rent: 100% of the defaulting roommate's share of monthly rent from the date they stopped paying until the date a replacement roommate began paying (or the lease ended), provided you made reasonable efforts to mitigate damages by looking for a replacement roommate or allowing them to find a qualified subtenant.
- Unpaid Shared Utilities: Their proportionate share (e.g., 50% or 33%) of electric, gas, water, trash, and internet bills incurred during the lease term (or early contract cancellation fees if their abandonment forced you to cancel utility accounts early).
- Late Fees, NSF Fees, and Lease Buyout Fees: Any late fees charged by the landlord specifically caused by the roommate's failure to pay their share on time, or their share of an early-termination fee if their abandonment forced both of you out of the lease.
- Cleaning, Hauling, and Repair Deductions from the Security Deposit: If the landlord deducted $600 from the joint security deposit at move-out because your roommate punched a hole in their bedroom wall, left trash behind, or never returned their keys, you can recover 100% of the deductions attributable to their specific conduct.
- Court Filing Fees and Process Server Costs: Awarded automatically to the prevailing plaintiff in almost all small claims jurisdictions.
How to prove a Roommate Contribution claim when you never signed a separate "Roommate Agreement"¶
Many renters worry: "Our lease with the landlord just says we owe $2,400 together; it doesn't say on the lease that John pays $1,200 and I pay $1,200. How do I prove our split in court?"
- The Legal Presumption of Equal Shares: Under contract and property law across the United States, Canada, the UK, and Australia, when two or more people sign a joint lease without a separate written agreement specifying unequal shares, the law presumes an equal division of liability (50/50 for two co-tenants, 33.3% each for three co-tenants).
- Proving an Unequal Split via "Course of Performance": If one roommate had the master bedroom with a private bathroom and agreed to pay $1,400 while you paid $1,000, you prove that oral agreement in Small Claims Court using 6 months of Venmo, Zelle, CashApp, or bank transfer history showing they transferred exactly $1,400 on the 1st of every prior month, plus initial texts or emails discussing the room price split when you moved in together.
- How to find and serve a roommate who vanished ("Skip Tracing"): To sue in Small Claims Court, you must serve the defendant with the court summons. Before your roommate disappears completely (or right after), check your original joint lease application packet or ask your landlord for the roommate's Emergency Contact (usually their parents' name and address), Employer name and address, Vehicle license plate, or Forwarding Address submitted for the security deposit. In most states, a registered process server or Sheriff's deputy can legally serve the summons on the defendant at their workplace, or via Substituted Service at their new residence or parents' residence if they moved back home. For full courtroom preparation steps, see Xulgado de pequenas reclamacións, cartas de esixencia e sentenzas por defecto.
Preguntas frecuentes¶
My roommate is still living in the apartment, eating food, and running up the A/C, but refuses to pay a single dollar of rent. Can I change the locks or shut off the Wi-Fi?
You can NEVER change the door locks, shut off water, electricity, or heat, or remove their bedroom door. Doing so is an illegal self-help eviction that exposes you to criminal and civil liability. However, because high-speed home Wi-Fi and streaming subscriptions are private consumer contracts in your individual name rather than statutory "essential housing habitability utilities," if the Wi-Fi account is strictly in your name and the roommate refuses to pay their agreed share of the internet bill, you are legally permitted to change the router password to block their free access. To get a non-paying co-tenant out of the apartment when they refuse to leave voluntarily, you must either (1) work with the landlord to serve a joint termination/eviction notice while signing a pre-arranged agreement with the landlord to sign a new solo lease once the roommate vacates, or (2) offer the deadbeat roommate a small "Cash-for-Keys" payment ($300 to $500 paid ONLY after their boxes are loaded in a truck outside and they hand you their keys and sign a Roommate Surrender Receipt) to leave immediately.
Can I take my name off a joint lease if my roommate and I had a falling out and I move out early?
Moving your body and furniture out of the apartment and handing your keys to your roommate does NOT remove your name or financial liability from the lease. A Joint and Several Lease is a three-way binding contract between You, Your Roommate, and the Landlord. Your name can only be removed before the lease expires if ALL THREE parties sign a written Lease Modification / Roommate Release Addendum, and a landlord will almost never agree to release your income and credit from the lease unless (a) your remaining roommate proves they now earn 3x the entire rent on their own, OR (b) you bring in a qualified replacement roommate who passes the landlord's credit screening and signs on to replace you.
What happens at the end of a 12-month lease if I want to move out on the expiration date, but my roommate wants to stay (hold over) month-to-month?
This is a critical legal trap that catches thousands of tenants off guard. If your 12-month lease automatically converts into a month-to-month periodic tenancy at expiration unless terminated, check your state's common-law rule on whether one co-tenant can unilaterally terminate a periodic tenancy: in the majority of jurisdictions (including California under Schmitt v. Felix and UK periodic tenancies under Hammersmith and Fulham LBC v. Monk), serving the landlord a formal 30-day or 60-day written Notice of Intent to Vacate and Surrender Possession at the end of the fixed term legally terminates your month-to-month liability once you vacate and return your keys directly to the landlord, forcing the remaining roommate to sign a new agreement with the landlord. Always serve your Notice of Non-Renewal and Key Surrender on the landlord via Certified Mail at least 30 to 60 days before the lease expires.
If our lease ends and the landlord sends one single Security Deposit refund check made payable to "John Smith AND Jane Doe," how do I cash it if my ex-roommate disappeared or refuses to sign it?
Notice the difference between "John Smith OR Jane Doe" (which either person can endorse and deposit alone) and "John Smith AND Jane Doe" (which under Uniform Commercial Code Section 3-110 requires the endorsement signature of BOTH payees to cash or deposit). To prevent this stalemate before moving out, send the landlord a written request asking them to issue two separate checks (or an electronic ACH split) according to a signed authorization, or if your roommate abandoned the unit months ago, provide the landlord proof of abandonment and receipts showing you paid 100% of the rent and move-out cleaning yourself. If the bank refuses to deposit a joint "AND" check because your ex-roommate refuses to endorse it, call the landlord's accounting office, return the uncashed check, and ask them to reissue separate checks or hold the disputed portion until resolved in Small Claims Court.
Should I sue my non-paying roommate in Small Claims Court right now while we still have 5 months left on the lease, or wait until the lease ends?
In almost all cases, you can only sue in Small Claims Court for damages you have ALREADY actually paid out of pocket, as a judge generally cannot award you "future rent for the next 5 months that hasn't come due yet." However, because each monthly rent default on an installment lease is a separate breach, you have two choices: (1) if you find a replacement roommate after 2 months, your damages are locked in as soon as the replacement moves in, so you can sue the ex-roommate immediately for those 2 months of unpaid rent plus replacement advertising costs; or (2) if you are covering the entire rent for the final 3 to 4 months of the lease, wait until the lease ends and the security deposit accounting is completed so you can sue once for the entire accumulated total (being careful not to exceed your state's Small Claims dollar cap, which typically ranges from $5,000 to $20,000).
What if my roommate put the electric or internet bill in their name, took my half of the bill money in Venmo, and then ran away without paying the utility company?
Here, having the utility account in the vanished roommate's name actually works in your favor. Utility accounts (electric, gas, internet) are personal consumer credit contracts belonging to the specific person whose Social Security Number opened the account, NOT liens against the apartment (with rare exceptions for municipal water/sewer attached to property deeds). Call the electric, gas, and internet companies immediately, tell them the prior account holder vacated the premises on [Date], show them your lease proving you live there, and ask to open a brand-new, clean utility account in your own name starting today. The utility company cannot force you to pay off your vanished ex-roommate's delinquent account balance as a condition of opening service in your own name, and you can include the stolen Venmo utility payments in your Small Claims suit against the ex-roommate. See Aviso de corte de servizos públicos for utility consumer rights.
