Iwalaaye Itanjẹ Ṣiṣayẹwo Cashier Fake (Oṣuwọn Aṣeju, Iṣẹ Iro, tabi Jibiti Olura lori Ayelujara)¶
Every day, honest consumers and freelancers fall victim to the Counterfeit Cashier's Check / Overpayment Scam:
- You sell a car, couch, or camera online (or accept a remote "administrative assistant / mystery shopper" job, or sublet an apartment), and the buyer/employer mails you a realistic-looking Cashier's Check (or tells you to print an emailed check image for mobile deposit) for \(3,500** when you were only owed **\)500.
- They tell you to deposit the check into your bank account and, as soon as your bank app shows the \(3,500 as **"Available Funds"** the next morning, to wire, Zelle, or buy gift cards for the extra **\)3,000** to pay a "mover," "shipping agent," or "software vendor."
- One week later, the cashier's check bounces back as a 100% counterfeit forgery. Your bank reverses the entire \(3,500 deposit, leaving your checking account **negative -\)3,000**, freezes all your accounts, demands immediate repayment, and blacklists you on ChexSystems and Early Warning Services (EWS) for "Account Abuse / Suspected Fraud" for 5 years.
Why "Available Funds" does NOT mean a check has "Cleared" (The Regulation CC Trap)¶
Under the federal Expedited Funds Availability Act (Regulation CC, 12 C.F.R. Part 229), US banks are legally required to make the first $225 to \(275 of a check deposit available the next business day, the rest of a standard check available within **2 business days**, and up to **\)5,525 of a Cashier's Check** available on the very next business day (if deposited in person).
However, funds availability is NOT final check settlement. It takes 5 to 14 business days (and up to several weeks for credit union or foreign drafts) for the physical/electronic check image to travel through the Federal Reserve to the purported issuing bank, be flagged as a counterfeit, and return unpaid. Under UCC § 4-214 (Right of Charge-Back), you (the depositor) bear 100 percent of the liability when a check you deposited is returned unpaid, even if a bank teller told you at the counter that the check "looked good" or "had cleared."
Emergency Damage-Control Protocol if You Already Deposited a Fake Check¶
- If you have NOT yet sent any money to the scammer: Leave every single dollar of the deposit untouched in your account so that when the bank reverses the $3,500 check in a few days, the exact $3,500 is sitting there to absorb the charge-back without sending your account negative. Walk into a physical branch today, ask for the Branch Manager, hand them a written note stating that you just realized the buyer/employer who sent the check is a scammer, and ask them to place a voluntary hold on the funds so your account is not flagged as a complicit fraud account.
- If you ALREADY wired, Zelled, or sent gift cards before the check bounced:
- Within 24 hours of a wire: Follow the emergency SWIFT/Fedwire recall protocol immediately (see our guide on real estate closing wire fraud and emergency bank recall protocol). If you bought gift cards (Apple, Target, Home Depot, Razer Gold), call the gift card issuer's corporate fraud line immediately with the receipt and card numbers to freeze any unspent balance on the card.
- Prevent criminal/fraud blacklisting on ChexSystems and EWS: When a fake check bounces and leaves your account negative -$3,000, the bank's automated security algorithm often assumes you printed the fake check yourself and closes your account with a ChexSystems "Suspected Fraud" tag (which prevents you from opening a checking account at any bank in the country for 5 years). To prevent this, file an FTC Identity Theft / Fraud Report, an FBI IC3 Report (
ic3.gov), and a Local Police Report showing the scammer's texts, emails, and job listing, and deliver copies to the bank's Loss Prevention / Executive Office. Prove that you were the victim of third-party fraud, negotiate a 12- to 24-month zero-interest repayment plan for the negative balance, and submit a Fair Credit Reporting Act (FCRA) Dispute to ChexSystems (chexsystems.com) and Early Warning Services (earlywarning.com) removing any "Fraud" notation.
What if a legitimate Cashier's Check, Certified Check, or Money Order is lost or stolen?¶
Unlike a personal check, you cannot simply place a regular stop-payment order on a Cashier's Check, Certified Check, or Teller's Check once it has been issued, because a cashier's check is a direct obligation guaranteed by the issuing bank itself (UCC § 4-403 Official Comment 4).
If a real $20,000 cashier's check (for example, for a house down payment or car purchase) is lost or stolen in the mail, you must use the special statutory procedure under Uniform Commercial Code (UCC) § 3-312 ("Lost, Destroyed, or Stolen Cashier's Check, Teller's Check, or Certified Check"):
- File a Formal Written "Declaration of Loss" Under UCC § 3-312: Contact the issuing bank immediately and execute a sworn Declaration of Loss under penalty of perjury stating that (a) you were in possession of the check (or entitled to enforce it), (b) the loss of possession was not the result of a lawful transfer, and © you cannot reasonably obtain possession of the check because it was destroyed or stolen.
- Understand the Mandatory 90-Day Statutory Waiting Period (or Indemnity Bond Alternative): Under UCC § 3-312(b)(1), a Declaration of Loss becomes legally enforceable 90 calendar days after the date of the cashier's check (not 90 days after you report it). Why? Because if an innocent "Holder in Due Course" presents the cashier's check within those first 90 days, the issuing bank is legally required to pay it. Once the 90th day passes without the check being cashed by a holder in due course, the issuing bank must refund the full $20,000 to you or issue a replacement cashier's check. (Tip: If you cannot wait 90 days because a real estate closing is tomorrow, you can purchase a Lost Instrument Surety / Indemnity Bond, typically costing 1.5% to 3% of the check amount through a surety agency, which protects the bank and allows them to reissue the funds immediately under UCC § 3-309).
Formal UCC Demand Letter to Your Bank for Washed, Counterfeit, or Forged Checks¶
If your bank refuses to recredit your checking account for a washed check, counterfeit check, or forged endorsement, or drags its feet for months waiting on the thief's depository bank, send this formal statutory notice via USPS Certified Mail with Return Receipt Requested to your bank's Fraud Department and Legal/Executive Office:

- [Option A - Washed / Altered Check (UCC § 4-401(d) & § 3-407):] Check #[Number] was stolen from the mail after I wrote it to [Original Payee] for $[Original Amount], and was chemically washed and materially altered without my authorization to read $[Altered Amount] payable to [Thief Name]. Under UCC § 4-401(d), a bank may charge a customer's account on an altered item only according to its original tenor.
- [Option B - Counterfeit Check / Forged Maker Signature (UCC § 3-401 & § 3-403):] Check #[Number] is a counterfeit instrument bearing a forged maker signature that I never signed or authorized. Under UCC § 4-401(a), a check bearing a forged maker signature is wholly inoperative and strictly not properly payable.
- [Option C - Forged Payee Endorsement (UCC § 3-420 & § 4-208):] Check #[Number] was stolen in transit and negotiated over a forged payee endorsement without the authorization of the intended payee [Payee Name]. Under UCC § 4-401(a), a check bearing a forged endorsement is not properly payable.
NOTICE REGARDING INTERBANK WARRANTY RECOVERY (UCC § 4-208):
While your institution is entitled to recover its loss from the Depository Bank ([Thief's Bank Name]) for breach of statutory presentment warranties under UCC § 4-208(a), your duty under UCC § 4-401 to recredit my account for an item that was never properly payable is direct and independent. It is unlawful to hold my personal funds hostage for months pending interbank collection.
DEMAND:
I demand that [Your Bank Name] immediately recredit my account in the full amount of $[Total Amount] (plus all associated fees) within 10 business days. If my account is not recredited by [Date], I will file formal regulatory enforcement complaints with the [Office of the Comptroller of the Currency (OCC) / Consumer Financial Protection Bureau (CFPB) / Federal Reserve] and pursue all statutory remedies.
Sincerely,
[Your Signature]

How to permanently prevent check washing and mail check fraud¶
- Stop mailing paper checks whenever possible; if you must mail a check, walk inside the post office: Never put an envelope containing a check inside your residential mailbox with the red flag up, and never drop it into an outdoor blue USPS street collection box after the last daily pickup time. Walk inside the physical Post Office lobby and drop it into the interior mail slot.
- Write all checks solely with a black Uni-ball 207 (or equivalent pigment-based gel pen): Standard ballpoint pens use dye-based ink that dissolves completely in nail polish remover (acetone) in seconds. Gel pens that use pigment-based ink (such as the Uni-ball 207, Sharpie S-Gel, or Pentel EnerGel labeled "Check Safe / Fraud Prevention") contain microscopic pigment particles that trap permanently inside the paper fibers and cannot be washed off with chemicals without destroying the check paper.
- Eliminate blank spaces on the Payee and Amount lines: Fill the entire Payee line and the written-word dollar line completely to the right margin by drawing a thick horizontal line (
========) through any remaining blank space so a thief cannot insert extra digits or words (for example, turning"One hundred"sinu"Nine thousand One hundred"). - Enable "Positive Pay" on all business checking accounts: If you run a small business, non-profit, or HOA, enable Positive Pay and ACH Positive Pay with your commercial bank. With Positive Pay, you upload a simple list of check numbers, dates, and dollar amounts whenever you write a check; if any washed or counterfeit check is presented that does not match your uploaded list to the penny, the bank automatically rejects it before a single cent leaves your account.

How long does a bank have to refund my money after a paper check is washed or forged?
Unlike electronic debit card and ACH disputes under Regulation E (which mandate a strict 10-business-day provisional credit), paper check disputes governed by Uniform Commercial Code (UCC) Articles 3 and 4 do not have an automatic 10-day federal provisional credit rule unless the check was converted into an electronic ACH check conversion. Banks often try to delay paper check refunds for 60 to 120 days while pursuing a UCC § 4-208 breach of presentment warranty claim against the thief's depository bank. However, you can dramatically accelerate your refund by submitting a notarized Affidavit of Alteration/Forgery, a USPIS Mail Theft Report, a local police report, and a formal UCC § 4-401 Demand Letter, and by filing an immediate complaint with the CFPB (`consumerfinance.gov/complaint`) and the Office of the Comptroller of the Currency (`helpwithmybank.gov`).
What is the UCC "Repeater Rule" (30-Day Rule) and how can it cost me my money?
Under Uniform Commercial Code (UCC) § 4-406(d)(2), if the same wrongdoer (such as a crooked bookkeeper, caregiver, or mail thief) forges or alters multiple checks on your account over several months, you must report the first unauthorized check to your bank within a reasonable time not exceeding 30 calendar days after the bank sends or makes available your first monthly statement showing that first bad check (many bank deposit contracts shorten this window to 14 days). If you fail to examine your bank statement and report that first forged check within the 14- to 30-day window, you are legally barred from recovering on any subsequent checks forged by that same person after the 30-day window expired and before you finally notified the bank.
Can my bank freeze my entire checking account and keep my real paycheck money because I deposited one bad check from a scammer?
When a deposited check is suspected of being counterfeit, Regulation CC and your deposit agreement allow the bank to place an extended hold on the amount of the questionable check and to set off a negative balance against other funds in your account. However, banks sometimes unlawfully freeze thousands of dollars of your legitimate payroll funds for months even after the fake check has already been charged back without a loss to the bank. If your bank freezes legitimate unencumbered funds beyond the amount of the returned check, file an immediate complaint with the CFPB and OCC demanding the release of your undisputed funds.
How can I verify whether a Cashier's Check is real before accepting it for a car sale or sublet?
Never rely on the phone number printed on the front of the cashier's check (scammers print their own accomplice's phone number on fake checks). Instead, independently look up the official customer service telephone number of the issuing bank on Google or the FDIC BankFind directory, call the bank's verification line yourself, and give them the Cashier's Check serial number, date, exact dollar amount, and payee name to verify that the check is authentic and active. Better yet, for private vehicle sales, insist on meeting the buyer physically inside the buyer's own bank branch and watching the bank teller print and hand the cashier's check directly to you at the counter.
