  • For Employers and Managers: Clearly post "PRIVATE: EMPLOYEES ONLY: NO ENTRY WITHOUT PERMISSION" signs on all doors separating public lobbies from back-of-house kitchens, warehouses, and offices. Train receptionists and shift managers never to give consent for agents to enter private work areas or hand over employee Form I-9 files on the spot (note: for an I-9 Employment Eligibility Audit, federal regulations under 8 C.F.R. Section 274a.2(b)(2)(ii) guarantee employers a mandatory 3 full business days from service of a written Notice of Inspection (NOI) before they must produce I-9 forms, never waive the 3-day notice window).
  • For Workers During a Raid: Do not run for the exits or hide inside dangerous machinery or ceilings. Running immediately singles you out and gives agents legal grounds to detain you. Keep working calmly or stand still. If an agent approaches you and blocks the exit, ask calmly: "Am I free to leave?" If they say no, state: "I am exercising my right to remain silent. I will not answer questions without a lawyer." Never line up in groups sorted by nationality or immigration status if agents ask workers to self-sort.

3. In a Vehicle or Traffic Stop (Police vs. ICE / Border Patrol)

  • Driver vs. Passenger Identification Rules: If your car is pulled over, the driver is legally required to show their driver's license, vehicle registration, and proof of insurance upon request. However, neither the driver nor any passenger is legally required to answer questions about their birthplace, citizenship, immigration status, or how they entered the country.
  • Refuse Vehicle Searches: Unless officers have independent probable cause to believe the vehicle contains criminal contraband, they cannot search your trunk, glovebox, or bags without your permission. State clearly: "I do not consent to a search of this vehicle or our belongings."
  • Within 100 Miles (160 Kilometers) of a US Land or Coastal Border (CBP Checkpoints): Under 8 U.S.C. Section 1357(a)(3), U.S. Customs and Border Protection (CBP) operates permanent and tactical immigration checkpoints on highways within 100 air miles of any external land or coastal border. At a fixed Border Patrol checkpoint, agents may briefly stop vehicles and ask citizenship questions without a warrant, but you still retain your Fifth Amendment right to remain silent, and agents cannot search your vehicle without either a warrant, probable cause, or your consent, nor can they hold you for an extended detention without reasonable suspicion.

4. What Documents You Should Carry (and Leave at Home) Every Day

Carry the right documents in your wallet based on your status, and leave foreign identity documents locked safely at home:

  1. If you have valid US Lawful Permanent Resident (Green Card), Employment Authorization Document (EAD / Work Permit), DACA, TPS, Asylum Pending Receipt, or Valid Nonimmigrant Visa Status: Under INA Section 264(e) (8 U.S.C. Section 1304(e)), adults age 18 and older who have been issued federal registration/status documents are legally required to carry their valid Green Card (Form I-551), Work Permit (Form I-766), or Form I-94 / Approval Notice with them (keep a high-resolution photocopy in your family emergency binder at home).
  2. If you are undocumented and have resided in the United States continuously for MORE THAN 2 YEARS: Carry photocopies (never originals) of documents showing your name and proving you have been physically present in the US for at least 2 continuous years (such as a state driver's license or municipal ID, lease agreements, utility bills, tax filing transcripts, or school/medical records, with no foreign birthplaces shown). Why? Under federal Expedited Removal rules (INA Section 235(b)(1)), ICE can attempt to deport someone without a hearing before an Immigration Judge only if they cannot prove 2 years of continuous physical presence in the United States. Proving 2+ years of presence protects your right to a full court hearing before an Immigration Judge.
  3. NEVER carry in your pocket: A foreign passport, foreign birth certificate, or Matrícula Consular / Consular ID card (unless expressly required at a scheduled consular appointment), and never carry fake or someone else's Social Security card or green card.

What to do if a loved one is detained by ICE (First 48 Hours)

Step 1: Locate the detainee using the ICE Online Detainee Locator (locator.ice.gov)

After an arrest, ICE transports individuals to a regional Enforcement and Removal Operations (ERO) Field Office for processing (which takes 6 to 24 hours) before assigning them to an ICE contract detention center. Locate them immediately:

  1. Search by A-Number (Fastest and Most Accurate): Go to https://locator.ice.gov and enter their 9-digit Alien Registration Number (A-Number), adding leading zeros after the "A" if the number has only 8 digits, plus their Country of Birth.
  2. Search by Biographical Information: If they have never been assigned an A-Number, search by First Name, Last Name, Date of Birth, and Country of Birth (try searching hyphenated or dual paternal/maternal last names both together and separately, as ICE clerks frequently enter both surnames or transpose them).
  3. If they do not appear after 24 hours: Call the local ICE ERO Field Office Outreach / Duty Officer covering the state where the arrest occurred, call the EOIR Automated Case Information Hotline at 1-800-898-7180 (or check acis.eoir.justice.gov by A-Number to see if a Notice to Appear has been docketed with an Immigration Court), and call their home country's Consulate / Embassy Protection Desk (under the Vienna Convention on Consular Relations, consulates have direct access to verify ICE custody and visit detained nationals).

Step 2: Warn your loved one NOT to sign a "Voluntary Departure" or Stipulated Removal

Inside the ERO processing center, ICE deportation officers frequently pressure newly arrested individuals, often telling them they will sit in detention for months if they ask for a judge, to sign Form I-826 (Notice of Rights and Request for Disposition) checking the box giving up their right to a hearing and requesting immediate return to their country, or a Stipulated Request for Removal Order.

The moment your loved one calls you from the processing center, tell them: - "Do NOT sign any paper you do not understand or any form waiving your right to see an Immigration Judge. Check ONLY the box on Form I-826 that says: 'I request a hearing before the Immigration Court to determine whether I may remain in the United States.'" - If they have a prior deportation order OR fear violence/persecution in their home country: Tell them to state clearly out loud to every officer and medical screener: "I am afraid to return to my country and I want a Credible Fear / Reasonable Fear Interview with an Asylum Officer." Expressing fear of return legally obligates ICE to pause deportation and refer the person to a USCIS Asylum Officer for a fear screening. - If your loved one is a Lawful Permanent Resident (Green Card Holder) stopped at an airport or detained: Warn them never to sign Form I-407 (Record of Abandonment of Lawful Permanent Resident Status). Only an Immigration Judge can strip a green card holder of permanent residency; CBP and ICE officers have zero power to take away a green card unless the holder voluntarily signs Form I-407.

Step 3: How to get an Immigration Bond (ICE Bond vs. Immigration Judge Bond Hearing)

Unlike criminal court bail, civil immigration release works through an Immigration Delivery Bond (Form I-352):

  1. Initial ICE Custody Determination (Form I-286): During booking, ICE serves Form I-286, which either sets a dollar bond amount (minimum 1,500 USD by statute, though ICE frequently sets bonds at 7,500 to 25,000 USD) OR checks "No Bond / Remain in Custody."
  2. Requesting an Immigration Judge Bond Redetermination Hearing: If ICE sets "No Bond" or sets an unaffordable 15,000 USD bond, an immigration attorney can immediately file a Motion for Custody Redetermination (Bond Hearing) with the Immigration Judge (EOIR) (assuming the person is not subject to mandatory detention under INA Section 236© for certain criminal convictions or arriving-alien rules). At the Bond Hearing, the Immigration Judge independently evaluates two factors under Matter of Guerra: (a) Is the person a danger to the community? and (b) Are they a flight risk?
  3. Assemble a "Bond Packet" for the Immigration Lawyer within 48 hours: Just like criminal arraignment, your lawyer wins a low bond (often 1,500 to 5,000 USD) by submitting a comprehensive Immigration Bond Packet containing:
  4. A Letter from a U.S. Citizen or Lawful Permanent Resident "Bond Sponsor / Obligor" stating the detainee will live at their verifiable street address and enclosing the sponsor's utility bill/lease and ID;
  5. Copies of Birth Certificates of U.S. Citizen or LPR Spouse and Children, plus school records and medical records;
  6. Proof of Tax Filings (IRS Transcripts / Form 1040 with ITIN or SSN), employment letters, church/community letters of good moral character, and proof of eligibility for relief from removal (such as 10-Year Cancellation of Removal under INA Section 240A(b), Marriage/Family Adjustment of Status, U-Visa for crime victims, VAWA, or Asylum).
  7. How to pay an Immigration Bond (CeBONDS): Never pay a predatory commercial "immigration bail bond company" (which charges exorbitant non-refundable fees and mandatory 400 USD/month GPS ankle-monitor contracts). Instead, once the judge grants a bond, any U.S. Citizen or Lawful Permanent Resident (Green Card Holder) can pay the bond directly to ICE online through the official cebonds.ice.gov (Cash Electronic Bonds Online) portal via wire transfer or ACH; 100 percent of that bond money plus accrued interest is refunded by the U.S. Treasury (via Form I-391 Notice of Immigration Bond Cancelled) at the end of the immigration court case, regardless of whether the person wins status or departs, as long as they attend all hearings.

Family Preparedness Blueprint: Protecting your children, home, and bank accounts

Every family with non-citizen members should assemble a Family Emergency Preparedness Binder today so that minor children and household finances are never left unprotected if a parent is detained:

  1. Execute a "Standby Guardianship / Power of Attorney for Minor Children" (and School Pickup Card):
  2. Update School & Daycare Emergency Pickup Lists Today: Add at least two trusted adult relatives or friends who have permanent legal status or U.S. citizenship to your children's school and daycare emergency pickup cards, because schools are legally barred from releasing a child to anyone not listed on the card.
  3. Sign a Statutory Caregiver Authorization Affidavit / Standby Power of Attorney for Minor Child: Every state allows parents to sign a notarized Power of Attorney for Care of a Minor Child / Caregiver's Authorization Affidavit (for example, California Family Code Section 6550, New York SCPA Section 1726 Standby Guardianship, or Texas Chapter 34 Authorization Agreement) designating a trusted adult to enroll the children in school, consent to medical/dental care, and care for them temporarily without terminating or surrendering your parental rights and without Child Protective Services (CPS) placing your children in foster care (see Расследование Службы защиты детей (CPS) и родительские права).
  4. Apply for Passports and Dual-Citizenship Registration for U.S.-Born Children: Obtain valid U.S. Passports for all U.S.-born children (so they can travel internationally if the family chooses to stay together) and register their birth at your home country's consulate.
  5. Execute a Financial Power of Attorney (POA) and Joint Bank Access: If an individual's sole checking account, paycheck, or vehicle title is only in their name and they are detained, their spouse or family cannot pay rent, sell the car, or access funds to pay the immigration bond. Add a trusted spouse or adult relative as a Joint Account Holder or Durable Financial Power of Attorney on bank accounts and vehicle titles.
  6. Keep the "Red Folder" of Important Documents in a Safe Place at Home: Store original birth certificates, marriage certificates, passports, ITIN letters, 10 years of tax returns and leases/utility bills (important for proving 10 years of continuous presence for Cancellation of Removal), vaccination records, and the phone number of a vetted immigration attorney in a single binder known to your trusted emergency contact.

Global immigration enforcement and detention rights (UK, Canada, Australia)

  • United Kingdom (Home Office Immigration Enforcement & Bail): Under the Immigration Act 1971 (Schedule 2), UK Immigration Enforcement officers cannot enter a private residential address without either your informed consent, a Warrant issued by a Justice of the Peace (Magistrate), or specific statutory authority written by an Assistant Director for certain offenses. During street or workplace checks, officers cannot stop and question people based solely on race or accent; they must have reasonable suspicion of an immigration breach. If detained and sent to an Immigration Removal Centre (IRC), every detainee is entitled to a free 30-minute legal advice surgery under the Detention Duty Advice Scheme (DDAS) (operated by the Legal Aid Agency) and can apply for Secretary of State Bail or First-tier Tribunal (Immigration and Asylum Chamber) Bail (Form B1) (which Automatically triggers a bail hearing after 4 months of detention).
  • Canada (CBSA & Mandatory 48-Hour IRB Detention Review): Under the Immigration and Refugee Protection Act (IRPA), anyone detained by the Canada Border Services Agency (CBSA) has an immediate right under Section 10(b) of the Charter to retain legal counsel and contact their consulate. The Immigration Division of the Immigration and Refugee Board (IRB) must hold a Detention Review Hearing within 48 hours of detention, again after 7 days, and every 30 days thereafter, where a Canadian citizen or permanent resident Bondsperson can propose a release plan.
  • Australia (Australian Border Force / ABF & Visa Cancellation Appeals): If the Australian Border Force (ABF) or Department of Home Affairs cancels a visa or detains an individual under Section 189 of the Migration Act 1958, strict deadlines (often 2 to 9 working days) apply to lodge a review with the Administrative Review Tribunal (ART) or apply for a Bridging Visa E (Subclass 050). Contact state Legal Aid Immigration Services or Refugee Legal immediately.

If ICE officers show up at my door wearing tactical vests that say "POLICE" on the front, how can I tell if they are local police or ICE agents?

ICE Enforcement and Removal Operations (ERO) officers routinely wear dark blue or black tactical vests with large yellow or white block letters reading **"POLICE"** across the chest (often with smaller text reading *"ICE"* or *"Federal Agent"* underneath). Whether the officers outside your closed door are local municipal police or federal ICE agents, **your constitutional Fourth Amendment right is 100 percent identical**: neither local police nor ICE agents can legally enter your home without your permission unless they have a **Judicial Warrant signed by a Court Judge** (or an active, life-threatening emergency inside). Never open the door to check their badges; ask them through the closed door to state their agency and slip any judge-signed warrant under the door.

Can I be arrested for recording a video on my phone of ICE agents or police detaining someone on the street or outside my home?

No, as long as you do not physically interfere. Every federal circuit court of appeals in the United States has recognized that the **First Amendment protects the right of bystanders and residents to openly record video and audio of law enforcement and immigration officers performing their official duties in public spaces** (or from inside your own property). To stay completely safe and lawful while recording: stand at a clear distance (at least **3 to 5 meters / 10 to 15 feet** back) so officers cannot claim you are physically obstructing them, hold your phone visibly (do not reach quickly into pockets), never step between an officer and a detainee, and set your phone to automatically back up video to the cloud or use an encrypted civil-rights recording app.

How do I protect my family from "Notario" fraud or fake immigration lawyers who promise they can get my loved one out of ICE custody immediately?

When a family member is detained by ICE, predatory scammers, especially unlicensed **"Notarios Públicos," "Immigration Consultants," or tax preparers**, prey on desperate families by charging 3,000 to 10,000 USD in cash while filing blank or fraudulent asylum applications that actually destroy the detainee's legal case. In Latin America, a *Notario Público* is a specialized attorney, whereas in the United States a **Notary Public is NOT a lawyer** and is strictly forbidden by law from giving legal advice or representing anyone in Immigration Court. Only hire a **licensed attorney** (verify their bar license online and confirm they are not on the **EOIR List of Currently Disciplined Practitioners**) or a **DOJ-Accredited Representative** working at a recognized nonprofit agency.

If I am a crime victim or domestic violence survivor without legal status, will calling 911 for police or emergency help get me deported?

Emergency medical paramedics and firefighters **never** ask for immigration status, and in the vast majority of jurisdictions, crime victims and witnesses who call 911 to report violent crime, domestic violence, human trafficking, child abuse, or sexual assault are **protected by federal victim-visa laws**. Specifically, the United States Congress created the **U Nonimmigrant Status (U-Visa)** for victims of qualifying crimes who suffered mental or physical abuse and assist law enforcement or prosecutors in investigating or prosecuting the crime, the **T-Visa** for victims of human trafficking, and the **Violence Against Women Act (VAWA) Self-Petition** for abused spouses, children, and parents of US citizens or green card holders, all of which provide work authorization, protection from deportation, and a pathway to a green card.
