Discovering that a stranger or criminal syndicate has recorded a forged Quitclaim Deed or Warranty Deed transferring ownership of your home, vacation house, or vacant land into their name, or has taken out a fraudulent 250,000 USD hard-money mortgage against your equity, is a terrifying financial emergency. Home title theft (also called Deed Fraud or Seller Impersonation Fraud) occurs when criminals pull public county land records, target properties with high equity or no active mortgage (especially homes owned by seniors, inherited estates, rental properties, and vacant lots), forge the homeowner's signature and a fake notary stamp on a deed, and record the forged document at the County Recorder's Office. Once the county clerk stamps the deed into the public index, the criminals either quickly take out a cash-out loan from a private lender and vanish, or list the property for a below-market cash sale to an unsuspecting buyer.

Here is the fundamental legal truth that every homeowner must understand first: under real property law in every US state and common-law jurisdiction, a forged deed is void ab initio (completely null and void from the moment of its creation) and can NEVER legally transfer ownership of your home, even to an innocent buyer or lender. However, because County Recorders are ministerial clerks who are legally required to record any properly formatted document without verifying whether the signature is real, clearing the cloud on your title and stopping a fraudulent foreclosure or sale requires immediate legal action. By filing an emergency Notice of Pendency of Action (Lis Pendens), initiating a Quiet Title Lawsuit, filing an Enhanced ALTA Homeowner's Title Insurance Claim, and enrolling in your County Recorder's free Property Recording Alert system, you can freeze the criminals' ability to profit and restore your clean chain of title.

  1. Protect your physical safety and never confront squatters or buyers at the property alone. If someone has broken into your home, changed the locks, or is physically threatening you at the property, step back to a safe location and call your local emergency number (911 in the United States and Canada, 112 across the European Union, 999 in the United Kingdom, or see nomba ya tshimpitshimpi).
  2. Pull a certified copy of the forged deed and any fraudulent mortgages from the County Recorder today. Go in person or online to your County Recorder / Register of Deeds / County Clerk's Land Records Index and download every document recorded under your name or Assessor's Parcel Number (APN) over the last 24 months. Look specifically at the Notary Acknowledgment block, the Return Recording Address, the Transfer Tax declaration, and the Commission Number of the Notary Public printed on the forged deed.
  3. If your property is currently listed for sale on the MLS by an impostor, call the listing real estate broker and the Title/Escrow Company immediately. Scammers frequently impersonate owners of vacant land or seasonal homes over email/WhatsApp and hire a legitimate local real estate agent to list the property for a fast cash closing. If you see a "For Sale" sign on your lawn or a Zillow/Redfin listing for your property, call the Listing Broker of Record and the Closing Title/Escrow Officer immediately, state that you are the true owner and the seller is an impostor, and follow up with an email attaching your ID and property tax bill to stop the wire transfer before closing.
  4. Record a Notice of Lis Pendens (Notice of Pendency of Action) and file a Quiet Title Action. Contact a real estate litigation attorney (or Legal Aid / Senior Law Project if you are a low-income or elderly homeowner) to file an emergency Action to Quiet Title and Cancel Void Instrument alongside a Temporary Restraining Order (TRO), and immediately record a Notice of Lis Pendens in the County Land Records. Recording a Lis Pendens puts the entire world, every title company, bank, and buyer, on constructive legal notice that the title is in litigation, making it 100 percent impossible for the scammer to sell or refinance the property.
  5. Check your Owner's Title Insurance Policy (ALTA Homeowner's Policy covers POST-POLICY forgery). Pull the Owner's Policy of Title Insurance you received when you bought your home. If you have an ALTA Homeowner's Policy of Title Insurance (Enhanced Policy), it explicitly covers post-policy forgery, impersonation, and deed theft occurring after you bought the home, meaning the title insurance company will hire and pay for your real estate lawyer to prosecute the Quiet Title lawsuit free of charge.
  6. File criminal reports with the County District Attorney's Real Estate Fraud Unit, the FBI (IC3.gov), and the State Secretary of State Notary Division. Report the felony deed forgery to your local police/sheriff White-Collar / Real Estate Fraud Unit, the District Attorney's Real Estate Fraud Prosecution Team, the FBI Internet Crime Complaint Center (ic3.gov), and your state's Secretary of State Notary Public Enforcement Unit (which investigates the stolen or complicit notary stamp used on the deed).

Do NOT pay 'Home Title Lock' or subscription monitoring companies $15 to $20 a month, they cannot 'lock' your deed

The Federal Trade Commission (FTC) and State Attorneys General have issued repeated consumer warnings against late-night radio and TV ads for private "Home Title Lock" subscription services claiming they "put a barrier around your title." No private company has the legal or technical power to "lock," freeze, or block a deed from being recorded at a government County Recorder's Office, and their paid service is NOT title insurance (it does not pay a penny for a lawyer if a fake deed is filed). All those companies do is check public county records and send you an email alert after a deed is recorded, a service that over 85 percent of US County Recorders, HM Land Registry in the UK, and state land registries now provide 100% FREE OF CHARGE.

How the 3 main types of Home Title Fraud work, and the law that defeats them

Understanding the legal distinction between a Forged Deed (Void Ab Initio) and a Deed Obtained by Fraud in the Inducement (Voidable) is the cornerstone of your legal defense:

Type of Deed Fraud How the Criminals Execute the Scheme Legal Status of the Deed & Your Defense
1. Pure Forgery / Impersonation Quitclaim Deed Criminals forge your signature on a Quitclaim or Grant Deed, apply a fake/stolen Notary stamp, and record it transferring your property to an LLC or straw buyer, who then takes out a hard-money mortgage or sells the home. VOID AB INITIO (100% Null and Void from the Start). Under universal common law, a forged deed conveys zero legal title, even to an innocent Bona Fide Purchaser (BFP) or innocent mortgage lender. Both the buyer's deed and the lender's mortgage are legally void and must be cancelled by the court.
2. Unrecorded Seller Impersonation Scam (Vacant Land / Second Homes) Criminals pose as you via email/text, hire a real estate agent to list your unencumbered vacant lot or vacation home below market price for "all cash," and forge your signature on the closing deed via a fake remote notary. VOID AB INITIO. If caught before closing, calling the listing broker and escrow company kills the deal instantly. If caught after closing, the buyer's title is void and the buyer must claim reimbursement from their new Owner's Title Insurance policy while your title is restored.
3. Predatory "Foreclosure Rescue" or Elder Equity Skimming (Fraud in the Inducement) A scammer approaches a homeowner facing foreclosure, delinquent property taxes, or cognitive decline, and tricks them into signing a stack of "refinance" or "loan modification" papers that secretly contain a real Quitclaim Deed signed by the homeowner's own hand. VOIDABLE (Requires Urgent Lis Pendens). Because the homeowner's physical signature is genuine (or obtained through trickery/undue influence), courts distinguish Fraud in the Factum (void) from Fraud in the Inducement (voidable). You must record a Lis Pendens immediately before the scammer sells or mortgages the house to an innocent third-party BFP.

Step-by-step: How to erase a forged deed and restore your title

Step 1: Why you CANNOT simply record a "Quitclaim Deed back to yourself"

When homeowners discover a thief recorded a forged Quitclaim Deed transferring their house to "XYZ Holdings LLC," many ask: "Why can't I just type up a new Quitclaim Deed or 'Affidavit of Forgery' transferring the property back to myself and pay 25 USD to record it?"

Here is why that does not work: - Once the County Recorder's Grantor/Grantee index shows "XYZ Holdings LLC" as the last recorded Grantee, a deed signed by you as Grantor sits outside the recorded chain of title ("a wild deed"). - Worse yet, if the thief already recorded a 200,000 USD fraudulent mortgage against the property under XYZ Holdings LLC, recording a new deed or affidavit does not erase that 200,000 USD mortgage lien, and no future title insurance company will ever insure a sale or refinance of your home until a Court Judgment (or an official statutory Corrective / Release Instrument signed by the adverse parties) formally cancels the forged deed and mortgage ab initio.

Step 2: Check whether your Owner's Title Insurance Policy pays for your lawyer

Before paying a real estate litigation attorney 5,000 to 15,000 USD out of pocket, pull the Owner's Policy of Title Insurance from your original home purchase closing binder (if you lost it, call the title company or escrow office that handled your purchase to request a duplicate policy):

  1. Standard ALTA Owner's Policy (2006 / 2021 Standard Form): Covers defects, liens, and forgeries that occurred on or before the date you bought the property (Exclusion 3(d) generally excludes post-policy events occurring after your purchase date).
  2. ALTA Homeowner's Policy of Title Insurance (Enhanced / Eagle / Gold Policy): In many states, residential buyers are issued the upgraded ALTA Homeowner's Policy by default (for only 10 percent more at closing). Look at Covered Risks 7 and 8 of the ALTA Homeowner's Policy: it explicitly insures you against post-policy forgery or impersonation after the Policy Date by which someone else claims to own an interest in your title or places a forged mortgage on your home. If you hold an Enhanced/Homeowner's policy, submit an immediate Notice of Title Claim to the underwriter (such as Fidelity National, First American, Old Republic, or Stewart Title), and they will appoint and pay 100 percent of the legal fees for a real estate litigation attorney to file your Quiet Title lawsuit and clear your deed.

Step 3: File a Quiet Title Lawsuit and record an immediate Lis Pendens

To legally expunge the forged deed and wipe out any fraudulent mortgages recorded by the thief, your attorney files a verified civil complaint in the county Superior/Circuit Court asserting: - Kubala 1: Tshienzedi bua kuikala ne tshiena bualu tshia ditalala; - Mukanda 2: Dishipa dia mukanda mufunda udi kauyi ne mushinga (muinshi mua mikenji ya ditunga bu mudi tshitupa tshia 3412 tshia mikenji ya ditunga ya mu Californie); - Tshilumbu 3: Dishima dia bumfumu ne dimanyisha dia disulakana; ne - Dilomba dia tshimpitshimpi dia mukenji wa tshitupa tshîpi (TRO) (bikala mufidi wa makuta wa dishima mulongolole bua kusumba bintu anyi muivi udi ukeba kukuipata).

Checking your County Tax Assessor Mailing Address (The Silent Warning Sign)

How do deed thieves record a forged deed and take out a loan without the homeowner finding out for six months? Right after recording the forged Quitclaim Deed, the thief submits a Change of Mailing Address Form to the County Tax Assessor / Property Appraiser, redirecting your annual property tax bills and legal assessment notices to a P.O. Box or vacant address controlled by the thief. In addition, in many states, recording a deed transfers the property out of your Homestead / Senior / Prop 13 Property Tax Exemption, causing your property tax assessment to skyrocket.

Take these two administrative steps with your County Tax Assessor today: 1. Verify and restore your Mailing Address of Record: Look up your property on the County Tax Assessor / Treasurer website and verify that the Owner Name and Tax Bill Mailing Address match your real address. 2. Lama dilekedibua dia bitadi bia nzubu ne dia bantu bakulumpe: Padi dilumbuluisha diebe dia Quiet Title anyi mukanda wa dilongolola dimane kufidibua, utume kopi kudi tshibambalu tshia dilekedibua dia bitadi tshia mu tshimenga bua kupingaja dilekela dia bitadi diebe ne kumbusha dipingaja dia bitadi dionso didi dienzeke bua dishima dia dishima.

  3. For Vacant Land or Unencumbered Second Homes: Record a Revocable Trust, Modest HELOC, or Right of First Refusal: Why do scammers overwhelmingly target free-and-clear (no mortgage) vacant lots and vacation homes? Because when a property has zero mortgage liens, the scammer's title company doesn't have to contact an existing bank to request a Mortgage Payoff Statement before closing. Opening a 0-balance Home Equity Line of Credit (HELOC) with your credit union (which records a Deed of Trust lien on the property even if you never borrow a dollar) or recording a Memorandum of Right of First Refusal / Option in favor of a trusted adult child or family LLC means no title company can ever close a sale without contacting your bank or family member for a formal payoff/release first.

  6. Form LL Counter-Fraud Restriction (The True Legal "Title Lock"): Unlike the US, in the UK you can actually file Form LL (Application for a Restriction by Owner not Living at the Property) (free of charge if you do not live at the property, or 40 GBP if you live there). Once a Form LL restriction is entered on your title register, HM Land Registry legally refuses to register any sale, transfer, or mortgage unless a solicitor or conveyancer personally certifies in writing that they have verified your identity and confirmed that you are the exact person who signed the deed.
  7. Canada (Provincial Land Titles Act Fraud Protection & Title Insurance): Under Canadian Torrens Land Titles systems (such as Ontario's Land Titles Act, British Columbia's Land Title Act, and Alberta), a confirmed victim of title fraud can apply to the provincial Director of Titles / Land Titles Assurance Fund to have the register rectified and fraudulent instruments deleted, and nearly all standard Canadian residential Owner's Title Insurance Policies (FCT, Stewart, Chicago Title, LawyerDoneDeal) include lifetime coverage for post-policy title fraud and mortgage forgery at no extra annual cost.

Nkonko itubu bela misangu ya bungi

If a criminal records a forged Quitclaim Deed on my house, can the police or sheriff come and evict me from my home tomorrow?

No. Even if a criminal records a forged deed and tries to claim they own your house, **no one can ever be legally evicted from a residence without a formal court lawsuit (Unlawful Detainer / Eviction Action), formal service of a court summons, a court hearing before a judge, and a final Writ of Possession**. In addition, as soon as you show the eviction court that the plaintiff's claim of ownership is based on a **disputed, forged Quitclaim Deed** and that you have filed a **Quiet Title lawsuit** (or file a Motion to Consolidate/Dismiss), summary eviction courts lack jurisdiction to adjudicate complex title fraud against a long-term homeowner in possession, and the Superior Court will issue a **Temporary Restraining Order (TRO)** halting any eviction while cancelling the forged deed.

Why are Quitclaim Deeds used in almost 90 percent of home title fraud cases?

Unlike a **Warranty Deed** or **Grant Deed** (where the seller legally warrants and guarantees that they actually hold clean, marketable title to the property), a **Quitclaim Deed** makes zero warranties of title, it simply says *"Whatever interest I might have in this property (even if zero), I transfer to you."* While Quitclaim Deeds were designed for legitimate, non-sale transfers between family members (such as adding a spouse to a title, transferring a home into a family Living Trust, or clearing title in a divorce), criminals abuse Quitclaim Deeds because they are simple 1-to-2-page forms that require no title search to record at the County Recorder's counter. That is also why legitimate title insurance companies treat any recent, uninsured Quitclaim Deed in a chain of title as a **major red flag** requiring direct verification with the prior owner before insuring a sale or loan.

Can I sue the Notary Public whose stamp appears on the forged deed?

It depends on whether the notary was actually involved or had their identity stolen too. In roughly **70 percent of modern forged deed cases**, the criminals never visited a real notary at all, instead, they looked up a real notary's name and Commission Number on the Secretary of State's public website and ordered a **counterfeit rubber notary stamp** online, forging both your signature and the notary's signature. In that case, the real notary is an innocent victim whose journal has zero record of the transaction (which is actually **great news for your Quiet Title case**, because the real notary will sign a sworn declaration stating *"That is not my signature or stamp and this person never appeared before me,"* proving the deed is a 100% forgery in 24 hours). However, if a real notary negligently notarized an impostor's signature without checking government ID or recording a thumbprint in their statutory journal, you can sue the notary and claim against their mandatory **State Notary Surety Bond** and **Errors & Omissions (E&O) Insurance**.

What if an elderly relative with dementia or Alzheimer's disease was tricked by a caregiver, relative, or scammer into physically signing a real Quitclaim Deed giving away their home?

When an elderly or vulnerable adult physically signs a deed due to **lack of mental capacity, dementia, undue influence, or elder financial abuse**, time is even more critical than in a stranger forgery case. Because the physical signature is theirs, the deed may be classified as *voidable* rather than *void ab initio* if they had mild cognitive impairment, meaning you **must file an Elder Financial Abuse & Quiet Title Lawsuit and record a *Lis Pendens* immediately** before the perpetrator sells or mortgages the house to an innocent third party. In most US states, statutory **Elder Abuse Civil Remedies** allow the court to rescind the deed, freeze the perpetrator's accounts via an immediate attachment order, and award double or treble damages plus mandatory attorney fees, and **Adult Protective Services (APS)** and the **District Attorney's Elder Abuse Unit** can prosecute the perpetrator criminally (see [financial abuse and exploitation](../work-and-finance/financial-abuse-and-exploitation.md)).
