- Make sure immediate physical and psychiatric safety during a school crisis. If your child is experiencing an acute psychiatric emergency, self-harm crisis, or physical injury from improper school restraint or seclusion, call your local emergency number (911 in the United States and Canada, 112 across the European Union, 999 in the United Kingdom, or see all أرقام الطوارئ) or a pediatric mobile crisis team immediately.
- Never pick up your child for an "informal send-home" without written suspension paperwork. When a school calls asking you to pick your child up early to "cool down" without logging an official suspension, demand an email from the principal stating that the school is ordering an administrative disciplinary removal; off-the-record early pickups are illegal attempts to bypass the 10-day federal special education protection clock.
- Count every single full-day, partial-day, in-school, and bus suspension toward the 10-day limit. Once a student with an IEP or 504 Plan is removed from their regular educational placement for more than 10 consecutive school days, or more than 10 cumulative school days in a single academic year that form a "pattern of removals", federal law classifies the discipline as a Disciplinary Change of Placement and strictly prohibits further removal without a formal hearing.
- Demand a formal Manifestation Determination Review (MDR) within 10 school days. Before any suspension exceeding 10 days or expulsion can take effect, the IEP team and parents must convene an MDR meeting to answer two statutory questions: (1) Was the conduct caused by, or did it have a direct and substantial relationship to, the child disability? and (2) Was the conduct the direct result of the school failure to implement the IEP? If the answer to either question is YES, the school must immediately return the child to school and cancel the expulsion.
- Submit a written FERPA / Educational Record request at least 5 days before the MDR. Immediately email the Special Education Director and Principal requesting all teacher behavior logs, Functional Behavioral Assessment (FBA) data, Behavior Intervention Plan (BIP) fidelity sheets, aide staffing schedules, witness statements, and hallway video footage from the date of the incident so you are not ambushed at the hearing.
- Invoke "Basis of Knowledge" protections immediately if your child does not have an IEP yet. Even if your child is currently in general education with no IEP or 504 Plan, you can halt an expulsion under 34 CFR 300.534 if a parent expressed concern in writing prior to the incident that the child needed special education, a teacher documented a pattern of behavioral concerns, or you submit an immediate written request for a full Special Education Evaluation during the suspension window.
Beware the pre-printed MDR form and the 'He knew right from wrong' trap
School administrators frequently walk into a Manifestation Determination Review (MDR) meeting with the determination form already pre-checked "NO" and argue: "Your child knows the difference between right and wrong, therefore this behavior was not a manifestation of their ADHD or Autism." Reject that standard immediately on the record. Under the 2004 IDEA congressional amendments (20 U.S.C. 1415(k)(1)(E)), whether a child abstractly "knows right from wrong" is not the legal test. The legal test is whether the disability impaired the child executive functioning, impulse control, sensory regulation, or emotional modulation in the heat of the moment, or whether the school failed to provide the sensory breaks, 1-on-1 aide, or de-escalation steps written in the IEP.

Phase 1: Halting "informal removals" and counting the 10-School-Day clock¶
Under federal special education regulations (34 CFR 300.530 through 300.536 under IDEA, and parallel protections under Section 504 enforced by the Office for Civil Rights), a school district may suspend a student with a disability for up to 10 school days in a school year to the same extent it suspends students without disabilities. However, the moment a removal exceeds 10 consecutive school days, or exceeds 10 cumulative school days that constitute a pattern of removals, it legally becomes a Disciplinary Change of Placement, triggering strict federal procedural safeguards.
What legally counts as a "Day of Removal" toward the 10-day ceiling¶
Because school administrators know that hitting Day 11 triggers mandatory special education services and a formal MDR hearing, many schools attempt to keep removals "off the books." Under formal guidance issued by the U.S. Department of Education Office of Special Education and Rehabilitative Services (OSERS), all of the following count toward the 10-day clock:
| Type of School Removal | When the School Tries to Exclude It | Why It Legally Counts Toward the 10-Day Limit |
|---|---|---|
| 1. "Informal Send-Homes" / Early Pickups | Principal or nurse calls at 10:30 AM saying: "He is having a rough day, pick him up now and we won't put a suspension on his record." | OSERS explicitly states that any partial-day shortened school day or early pickup requested by staff due to behavior counts as a disciplinary removal. |
| 2. Partial-Day Suspensions | Sending a student home for the afternoon (e.g., 2 hours left in the day). | Any partial day in which a child is excluded from class for behavioral reasons counts as a full day (or proportional day under state rules) toward the cumulative pattern of removals. |
| An In-School Suspension counts as a day of removal unless the student continues to: (a) appropriately progress in the general curriculum, (b) receive 100% of the specialized instruction and speech/OT services listed on their IEP, and © participate with non-disabled peers to the same extent as in their current placement. |
| 4. School Bus Suspensions | Banning the child from the school bus for 5 days for behavioral issues on the bus. | Counts as a day of suspension if special transportation is listed as a related service on the student IEP, or if the parent is unable to drive the child to school and the bus ban prevents the child from attending school. |
| 5. Unilateral Shortened School Days | Telling a parent: "She can only handle 2 hours a day, so pick her up at 10:00 AM every day." | Administratively shortening a disabled student school day due to behavioral staffing shortages without formal IEP team agreement and data violates FAPE and constitutes an ongoing removal. |
The email template to stop illegal "informal send-homes" immediately¶
Whenever the school calls asking you to pick your child up early without formal suspension paperwork, send this exact email to the Principal, Assistant Principal, Case Manager, and District Special Education Director before or immediately after picking up your child:
Subject: Documentation of Administrative Behavioral Removal, [Student Name, DOB]
"Today at [Time], [Staff Member Name] telephoned me and directed me to pick [Student Name] up early from school due to behaviors related to [his/her] disability, stating it would not be recorded as a formal suspension. Please be advised that under U.S. Department of Education OSERS guidance and 34 CFR 300.530, any administrative request to remove a student with an IEP/504 Plan for part or all of a school day due to behavior constitutes a disciplinary removal. Please record today removal of [X hours] on [Student Name] official disciplinary log toward the 10-cumulative-day Change of Placement threshold, provide Prior Written Notice (PWN), and convene an IEP meeting to review the Behavior Intervention Plan."
Once principals realize that every phone call is being logged on a formal paper trail copied to the district Special Education Director, off-the-record "come get your kid" phone calls almost always stop overnight.
Phase 2: Winning the Manifestation Determination Review (MDR)¶
When a school proposes to suspend a student with an IEP or 504 Plan for more than 10 consecutive days, expel the student, or impose a suspension that pushes the student past 10 cumulative days in a pattern of removals, the school must hold a Manifestation Determination Review (MDR) within 10 school days of the decision to change the placement.
The two-prong statutory legal standard (20 U.S.C. 1415(k)(1)(E))¶
At the MDR meeting, the school district representative, the parent, and relevant members of the IEP team must review all relevant information in the student file, including the IEP, teacher observations, and any clinical or diagnostic information provided by the parents, to answer two specific legal questions:
- Prong 1 (Clinical / Disability Causation): "Was the conduct in question caused by, or did it have a direct and substantial relationship to, the child disability?"
- Importantly: You are not limited to the single primary eligibility box checked on the cover page of the IEP (for example, "Specific Learning Disability" or "Speech or Language Impairment"). If your child has an IEP under "Other Health Impairment" or "Learning Disability" and also has a clinical diagnosis of ADHD, Autism, Anxiety, PTSD, or Oppositional Defiant Disorder (ODD), the MDR team must evaluate the relationship between the conduct and all aspects of the child disability profile.
- Prong 2 (School IEP Implementation Failure): "Was the conduct in question the direct result of the Local Educational Agency (LEA) failure to implement the IEP?"
- This is the most powerful, objective weapon a parent has in an MDR hearing. You do not even need to argue psychology under Prong 2; you only need to show that the school broke its own written contract on the day of the incident.
How to prove Prong 2 (School Failure to Implement the IEP / BIP)¶
Before the MDR meeting, read every single line of your child current IEP and Behavior Intervention Plan (BIP), specifically looking at the Supplementary Aids and Services, Program Modifications, and De-escalation Protocols. Compare what is written in the IEP against what actually happened in the 60 minutes leading up to the behavioral incident:
- Did the IEP require a 1-on-1 paraprofessional aide or inclusion support? Was the aide absent that day, at lunch, or pulled to cover another classroom when the incident happened?
- Did the IEP or BIP require proactive sensory breaks, movement breaks, or access to a "cool-down pass" / quiet corner when agitated? Did the teacher or substitute teacher deny the student request to take a sensory break or block the doorway when the child tried to step out to self-regulate?
- Did the BIP prohibit public verbal confrontation, yelling, or physical cornering? Did an assistant principal or untrained security guard grab the student arm, shout in their face in front of peers, or escalate a minor refusal into a fight-or-flight sensory meltdown?
- Did the IEP require modified assignments, visual schedules, or extended time? Did a teacher hand the student an unmodified exam or trigger task-frustration by refusing an accommodation?
If the school failed to deliver any material accommodation or de-escalation step required by the IEP/BIP right before the behavior occurred, Prong 2 is met.
How to prove Prong 1 (Direct and Substantial Relationship to Disability)¶
Do not rely solely on your own testimony at the MDR table:
- Obtain an emergency letter from your child treating psychiatrist, developmental pediatrician, neuropsychologist, or therapist: Ask your clinician to write a targeted, one-page letter on medical letterhead specifically quoting the federal statutory phrase. The letter should explain the neurological mechanism connecting the diagnosis to the specific behavior (for example: "In my clinical opinion, [Student] behavior on [Date], specifically throwing classroom materials and eloping when cornered, was caused by and had a direct and substantial relationship to his Autism Spectrum Disorder and severe ADHD, which impair prefrontal executive inhibition and trigger an involuntary autonomic fight-or-flight response during sensory overload").
- Show historical continuity across the IEP: Open your child past Functional Behavioral Assessments (FBAs) and IEP Present Levels of Academic Achievement and Functional Performance (PLAAFP). If the IEP itself already describes the student as struggling with "emotional regulation, verbal outbursts when frustrated, impulsivity, or peer conflict," point to that text on the table: "Your own IEP document identifies this exact behavior as a manifestation of his disability that the school was supposed to be remediating."
What happens legally when the MDR is "YES"¶
If the MDR team answers YES to either Prong 1 or Prong 2:
- Immediate return to school: The school must immediately return the child to the placement from which they were removed (unless the parent and school both voluntarily agree to change placement as part of modifying the behavioral plan, or unless the narrow 45-day Special Circumstances rule applies).
- Expulsion and long-term suspension are canceled: The disciplinary proceeding terminates immediately.
- Mandatory FBA and BIP: If the student did not already have a Functional Behavioral Assessment (FBA) and Behavior Intervention Plan (BIP), the school must immediately conduct an FBA and implement a BIP. If the student already had a BIP, the team must review and modify it to address the behavior, and if Prong 2 (failure to implement) was found, the school must take immediate steps to remedy those implementation deficiencies.
Phase 3: The 45-Day "Special Circumstances" Exception (Weapons, Drugs, Serious Bodily Injury)¶
There is only one narrow statutory exception under federal law (34 CFR 300.530(g)) where a school can remove a student to an Interim Alternative Educational Setting (IAES) for up to 45 school days even if the behavior was a manifestation of their disability:
- Dangerous Weapons: The student carries a weapon to school or possesses a weapon at school, on school premises, or at a school function.
- Critical Legal Definition: Under IDEA, "weapon" is strictly defined by 18 U.S.C. 930(g)(2) as a device, instrument, material, or substance that is used for, or is readily capable of, causing death or serious bodily injury, except that such term does NOT include a pocket knife with a blade of less than 2.5 inches (6.35 centimeters) in length. Schools routinely try to invoke the 45-day rule for plastic butter knives, scissors, pencils, or miniature Swiss Army knives, none of which meet the federal statutory definition of a dangerous weapon.
- Illegal Drugs or Controlled Substances: The student knowingly possesses or uses illegal drugs, or sells or solicits the sale of a controlled substance, while at school. (Does not apply to acontrolled substance legally possessed and used under the supervision of a licensed healthcare professional, such as prescribed ADHD medication).
- Serious Bodily Injury (SBI): The student has inflicted "serious bodily injury" upon another person while at school.
- Critical Legal Definition: School administrators frequently try to claim "Serious Bodily Injury" whenever a dysregulated child kicks a teacher shin, bites an arm, or leaves a bruise or scratch. Under 18 U.S.C. 1365(h)(3) (adopted directly into IDEA), Serious Bodily Injury has an extraordinarily high federal criminal threshold: it requires a bodily injury that involves (A) a substantial risk of death; (B) extreme physical pain; (C) protracted and obvious disfigurement; or (D) protracted loss or impairment of the function of a bodily member, organ, or mental faculty (such as a traumatic brain bleed, lost organ function, or severe fracture requiring hospitalization). Routine bruises, scratches, bites, or emotional distress never legally qualify as Serious Bodily Injury under IDEA, and Administrative Law Judges routinely overturn school 45-day removals that misuse this clause.
Phase 4: What to do if the school rigs the MDR ("NO"), Expedited Due Process and Stay-Put¶
Because an MDR does not require a unanimous vote if the school district representative overrides the parent objection, hostile school administrators sometimes rubber-stamp "NO" on both prongs to push through an expulsion or alternative-school transfer.
How to appeal an improper MDR and keep your child in school¶
- Refuse to sign "Agree" on the MDR determination form: Sign only to acknowledge your physical attendance at the meeting, and write clearly directly above your signature: "I dissent from the team determination. The behavior was both directly related to my child disability and a direct result of the district failure to implement the IEP."
What if the school had zero prior 'Basis of Knowledge'?
When a student with a disability experiences a sensory or behavioral crisis, untrained staff sometimes respond with prone physical floor restraints, locking the child alone in a padded "scream room" or closet, or calling a campus police officer (School Resource Officer) to handcuff or issue a juvenile criminal citation to a 9-year-old child.
- Demand the mandatory written Restraint and Seclusion Incident Report (which most states require schools to deliver to parents within 24 hours) and file a State Department of Education Compliance Complaint and an Office for Civil Rights (OCR) disability discrimination complaint.
- School Resource Officer (SRO) / Juvenile Referral Defense:
- If a school files a juvenile delinquency complaint or issues a disorderly conduct ticket for disability-related school behavior, immediately notify the juvenile court prosecutor and intake probation officer in writing that the child is a student with an individualized disability under IDEA/Section 504 whose behavior occurred during an unaccommodated school crisis, and attach the IEP and medical documentation.
When the school calls me at 11:00 AM asking me to pick up my child early to "help him have a better day" without issuing a formal suspension, does that count toward the 10-day limit?
Yes. Under official guidance from the U.S. Department of Education Office of Special Education and Rehabilitative Services (OSERS), "informal removals", including calling parents to pick a child up early, asking parents to keep a child home for a day to "cool off," or unilaterally shortening the child school day due to behavioral challenges, count as disciplinary removals toward the 10-school-day Change of Placement ceiling. Always reply by email documenting the exact time you were asked to pick your child up so the removal is formally logged on the 10-day clock.
Do In-School Suspensions (ISS) and school bus suspensions count toward the 10 cumulative days of suspension?
Yes, in most cases. An In-School Suspension (ISS) counts as a day of disciplinary removal unless the school proves that while in ISS, your child continued to progress in the general curriculum, received 100 percent of the special education instruction and related services (like speech, OT, or counseling) mandated by their IEP, and participated with non-disabled peers to the same extent as usual. Similarly, a school bus suspension counts as a full day of suspension if transportation is listed as a related service on your child IEP, or if you have no alternative way to get your child to school during the bus ban.
At the Manifestation Determination Review (MDR) meeting, the principal said my child behavior wasn't a manifestation because "he knew right from wrong." Is that legal?
No. Whether a student cognitively "knows right from wrong" is NOT the legal standard under the Individuals with Disabilities Education Act (IDEA). Under 20 U.S.C. 1415(k)(1)(E), the MDR team must answer two specific questions: (1) Was the conduct caused by, or did it have a direct and substantial relationship to, the child disability? or (2) Was the conduct the direct result of the school failure to implement the IEP? A child with ADHD, Autism, Tourette Syndrome, or Emotional Disturbance may understand rules when calm, yet experience neurological executive-function failure or fight-or-flight sensory dysregulation when overstimulated or when staff fail to provide their IEP accommodations.
What happens if my child hits a teacher or throws a chair, can the school automatically move them to an alternative school for 45 days for "Serious Bodily Injury"?
No, unless the injury meets the extreme federal criminal definition of "Serious Bodily Injury" under 18 U.S.C. 1365(h)(3). Under IDEA, a school can only invoke the 45-day Interim Alternative Educational Setting (IAES) injury exception if the student inflicted an injury involving a substantial risk of death, extreme physical pain, protracted and obvious disfigurement, or protracted loss or impairment of a bodily member, organ, or mental faculty. Bruises, scratches, bites, redness, or emotional upset do not legally qualify as Serious Bodily Injury, and if the MDR is a manifestation, the student must be returned to their placement.
My child does not have an IEP or 504 Plan yet, and the school just suspended them and recommended expulsion. Can I still stop the expulsion under special education law?
Often yes. Under 34 CFR 300.534, a student without an IEP is entitled to full IDEA disciplinary protections (including a Manifestation Determination Review) if the school had a "Basis of Knowledge" that the child might have a disability before the incident occurred. You establish Basis of Knowledge by showing a single email or note where you previously told a teacher or administrator you were worried about your child behavior/learning, or by showing that teachers previously documented a pattern of behavioral concerns. Even if there was zero prior record, submit a written request for a Special Education Evaluation immediately today, by law, the school must conduct an expedited evaluation during the suspension period.
What must I do if the school team outvotes me at the MDR meeting and checks "NO" to push through an expulsion?
First, do not sign "Agree" on the MDR form, write clearly above your signature that you dissent from the determination. Second, immediately request an Independent Educational Evaluation (IEE) at public expense. Third, contact a Parent Training and Information Center (PTI), Disability Rights protection and advocacy agency, or special education attorney to file an Expedited Due Process Complaint under 34 CFR 300.532. Filing an expedited appeal forces a resolution meeting within 7 days and an impartial hearing within 20 school days, and starting on Day 11 of any removal, the school is legally required to provide full IEP educational services so your child does not fall behind.
