Receiving a phone call from a school principal or assistant principal demanding that you come pick up your child immediately because of a behavioral crisis, or opening a formal notice of a long-term suspension or expulsion hearing for a student with an Individualized Education Program (IEP), a Section 504 Plan, or an undiagnosed disability, is an urgent legal and educational emergency. Across public and charter schools, students with autism spectrum disorder, attention-deficit/hyperactivity disorder (ADHD), emotional disturbance, sensory processing differences, tourette syndrome, or trauma histories are disproportionately subjected to exclusionary discipline, including off-the-record "informal send-homes," repeated bus suspensions, and disciplinary removals triggered precisely because the school failed to implement the student legally binding behavioral accommodations.
Under the federal Individuals with Disabilities Education Act (IDEA), Section 504 of the Rehabilitation Act, the UK Equality Act 2010 and SEND Code of Practice, and Canadian provincial human rights statutes, public schools cannot simply expel or repeatedly suspend a child for behavior that is caused by their disability or by the school failure to follow their IEP. By tracking every partial-day removal toward the statutory 10-School-Day Change of Placement threshold, preparing clinical and implementation evidence for the mandatory Manifestation Determination Review (MDR), invoking Expedited Due Process and Stay-Put protections, and asserting statutory protections for children not yet evaluated for special education, parents and caregivers can halt unlawful school pushout immediately.
Egin hau orain¶
- Make sure immediate physical and psychiatric safety during a school crisis. If your child is experiencing an acute psychiatric emergency, self-harm crisis, or physical injury from improper school restraint or seclusion, call your local emergency number (911 in the United States and Canada, 112 across the European Union, 999 in the United Kingdom, or see all larrialdi zenbakiak) or a pediatric mobile crisis team immediately.
- Never pick up your child for an "informal send-home" without written suspension paperwork. When a school calls asking you to pick your child up early to "cool down" without logging an official suspension, demand an email from the principal stating that the school is ordering an administrative disciplinary removal; off-the-record early pickups are illegal attempts to bypass the 10-day federal special education protection clock.
- Count every single full-day, partial-day, in-school, and bus suspension toward the 10-day limit. Once a student with an IEP or 504 Plan is removed from their regular educational placement for more than 10 consecutive school days, or more than 10 cumulative school days in a single academic year that form a "pattern of removals", federal law classifies the discipline as a Disciplinary Change of Placement and strictly prohibits further removal without a formal hearing.
- Demand a formal Manifestation Determination Review (MDR) within 10 school days. Before any suspension exceeding 10 days or expulsion can take effect, the IEP team and parents must convene an MDR meeting to answer two statutory questions: (1) Was the conduct caused by, or did it have a direct and substantial relationship to, the child disability? and (2) Was the conduct the direct result of the school failure to implement the IEP? If the answer to either question is YES, the school must immediately return the child to school and cancel the expulsion.
- Submit a written FERPA / Educational Record request at least 5 days before the MDR. Immediately email the Special Education Director and Principal requesting all teacher behavior logs, Functional Behavioral Assessment (FBA) data, Behavior Intervention Plan (BIP) fidelity sheets, aide staffing schedules, witness statements, and hallway video footage from the date of the incident so you are not ambushed at the hearing.
- Invoke "Basis of Knowledge" protections immediately if your child does not have an IEP yet. Even if your child is currently in general education with no IEP or 504 Plan, you can halt an expulsion under 34 CFR 300.534 if a parent expressed concern in writing prior to the incident that the child needed special education, a teacher documented a pattern of behavioral concerns, or you submit an immediate written request for a full Special Education Evaluation during the suspension window.
Beware the pre-printed MDR form and the 'He knew right from wrong' trap
School administrators frequently walk into a Manifestation Determination Review (MDR) meeting with the determination form already pre-checked "NO" and argue: "Your child knows the difference between right and wrong, therefore this behavior was not a manifestation of their ADHD or Autism." Reject that standard immediately on the record. Under the 2004 IDEA congressional amendments (20 U.S.C. 1415(k)(1)(E)), whether a child abstractly "knows right from wrong" is not the legal test. The legal test is whether the disability impaired the child executive functioning, impulse control, sensory regulation, or emotional modulation in the heat of the moment, or whether the school failed to provide the sensory breaks, 1-on-1 aide, or de-escalation steps written in the IEP.

Phase 1: Halting "informal removals" and counting the 10-School-Day clock¶
Under federal special education regulations (34 CFR 300.530 through 300.536 under IDEA, and parallel protections under Section 504 enforced by the Office for Civil Rights), a school district may suspend a student with a disability for up to 10 school days in a school year to the same extent it suspends students without disabilities. However, the moment a removal exceeds 10 consecutive school days, or exceeds 10 cumulative school days that constitute a pattern of removals, it legally becomes a Disciplinary Change of Placement, triggering strict federal procedural safeguards.
What legally counts as a "Day of Removal" toward the 10-day ceiling¶
Because school administrators know that hitting Day 11 triggers mandatory special education services and a formal MDR hearing, many schools attempt to keep removals "off the books." Under formal guidance issued by the U.S. Department of Education Office of Special Education and Rehabilitative Services (OSERS), all of the following count toward the 10-day clock:
| Type of School Removal | When the School Tries to Exclude It | Why It Legally Counts Toward the 10-Day Limit |
|---|---|---|
| 1. "Informal Send-Homes" / Early Pickups | Principal or nurse calls at 10:30 AM saying: "He is having a rough day, pick him up now and we won't put a suspension on his record." | OSERS explicitly states that any partial-day shortened school day or early pickup requested by staff due to behavior counts as a disciplinary removal. |
| 2. Egun partzialeko etenaldiak | Ikasle bat arratsalderako etxera bidaltzea (adibidez, egunean 2 ordu falta dira). | Portaera-arrazoiengatik haur bat klasetik kanpo geratzen den egun partzial oro egun oso bat (edo estatuko arauen arabera, egun proportzionala) zenbatzen da kentzeen eredu metaturako. |
| 3. In-School Suspension (ISS) / Isolation Rooms | Locking the student in an ISS detention room all day with worksheets. | An In-School Suspension counts as a day of removal unless the student continues to: (a) appropriately progress in the general curriculum, (b) receive 100% of the specialized instruction and speech/OT services listed on their IEP, and © participate with non-disabled peers to the same extent as in their current placement. |
| 4. School Bus Suspensions | Banning the child from the school bus for 5 days for behavioral issues on the bus. | Counts as a day of suspension if special transportation is listed as a related service on the student IEP, or if the parent is unable to drive the child to school and the bus ban prevents the child from attending school. |
| 5. Unilateral Shortened School Days | Telling a parent: "She can only handle 2 hours a day, so pick her up at 10:00 AM every day." | Administratively shortening a disabled student school day due to behavioral staffing shortages without formal IEP team agreement and data violates FAPE and constitutes an ongoing removal. |
The email template to stop illegal "informal send-homes" immediately¶
Whenever the school calls asking you to pick your child up early without formal suspension paperwork, send this exact email to the Principal, Assistant Principal, Case Manager, and District Special Education Director before or immediately after picking up your child:
Subject: Documentation of Administrative Behavioral Removal, [Student Name, DOB]
"Today at [Time], [Staff Member Name] telephoned me and directed me to pick [Student Name] up early from school due to behaviors related to [his/her] disability, stating it would not be recorded as a formal suspension. Please be advised that under U.S. Department of Education OSERS guidance and 34 CFR 300.530, any administrative request to remove a student with an IEP/504 Plan for part or all of a school day due to behavior constitutes a disciplinary removal. Please record today removal of [X hours] on [Student Name] official disciplinary log toward the 10-cumulative-day Change of Placement threshold, provide Prior Written Notice (PWN), and convene an IEP meeting to review the Behavior Intervention Plan."
Zuzendariak konturatzen direnean telefono dei bakoitza barrutiko Hezkuntza Bereziko zuzendariari kopiatutako paperezko arrasto formal batean erregistratzen ari direla konturatzen direnean, erregistrotik kanpo "zatoz zure seme-alabak hartzera" telefono deiak ia beti gelditzen dira egun batetik bestera.
Phase 2: Winning the Manifestation Determination Review (MDR)¶
Ikastetxe batek IEP edo 504 Plana duen ikaslea jarraian 10 egun baino gehiagoz etetea proposatzen duenean, ikaslea kanporatzea edo ikaslea 10 egun pila igarotzen dituen kentze eredu baten arabera, ikastetxeak Manifestation Determination Review (MDR) egin beharko du 10 eskola-eguneko barruan, kokapen-erabakia aldatzeko erabakiaren 10 eskola-eguneko barruan.
Legezko arau bikoitza (20 U.S.C. 1415(k)(1)(E))¶
MDR bileran, eskola-barrutiko ordezkariak, gurasoak eta IEP taldeko kide garrantzitsuak ikasleen fitxategian dagoen informazio garrantzitsu guztia berrikusi behar dute, besteak beste, IEPa, irakasleen behaketak eta gurasoek emandako edozein informazio kliniko edo diagnostiko, legezko bi galdera zehatz erantzuteko:
- 1. Atala (Kliniko/Ezgaitasunen Kausa): "Auzitako jokabidea haurraren ezintasunarekin zuzeneko eta funtsezko harremana izan al zen?"
- Garrantzitsua: ez zaude IEPren azalean markatutako hautagarritasun-koadro bakarrera mugatuta (adibidez, "Ikaskuntzarako ezintasun espezifikoa" edo "Hizkuntza- edo hizkuntza-urritasuna"). Zure seme-alabak IEP bat badu "Beste osasun-urritasuna" edo "Ikaskuntza-urritasuna" azpian eta TDAH, Autismoa, Antsietatea, PTSD edo Oposizioko Defiant Disorder (ODD) diagnostiko klinikoa badu, MDR taldeak jokabidearen eta haurren desgaitasun-profilaren guztien alderdien arteko erlazioa ebaluatu behar du.
- Prong 2 (Ikastetxeko IEP ezartzeko hutsegitea): "Zalantzan dagoen jokabidea Tokiko Hezkuntza Agentziaren (LEA) IEP ez ezarri izanaren ondorio zuzena izan da?"
- This is the most powerful, objective weapon a parent has in an MDR hearing. You do not even need to argue psychology under Prong 2; you only need to show that the school broke its own written contract on the day of the incident.
Nola frogatu Prong 2 (Eskola IEP / BIP ezartzeko hutsegitea)¶
MDR bileraren aurretik, irakurri zure haurraren egungo IEP eta Portaeraren Esku-hartze Planaren (BIP) lerro guztiak, bereziki Laguntza eta Zerbitzu osagarriak, Programen aldaketak eta Deseskalatze-protokoloak aztertuz. Konparatu IEPn idatzitakoa jokabidearen gertakariaren aurreko 60 minutuetan benetan gertatutakoarekin:
- Did the IEP require a 1-on-1 paraprofessional aide or inclusion support? Was the aide absent that day, at lunch, or pulled to cover another classroom when the incident happened?
- IEP edo BIP-ek zentzumen-etenaldi proaktiboak, mugimendu-etenaldiak edo "hozte-pasea" / txoko lasai baterako sarbidea behar al zuten asaldatuta dagoenean? Irakasleak edo ordezko irakasleak ukatu egin al zion ikasleari atseden sentsorial bat hartzeko edo atea blokeatzeko eskaerari haurrak autoerregulatzen saiatzen zenean?
- Did the BIP prohibit public verbal confrontation, yelling, or physical cornering? Did an assistant principal or untrained security guard grab the student arm, shout in their face in front of peers, or escalate a minor refusal into a fight-or-flight sensory meltdown?
- Did the IEP require modified assignments, visual schedules, or extended time? Did a teacher hand the student an unmodified exam or trigger task-frustration by refusing an accommodation?
If the school failed to deliver any material accommodation or de-escalation step required by the IEP/BIP right before the behavior occurred, Prong 2 is met.
How to prove Prong 1 (Direct and Substantial Relationship to Disability)¶
Do not rely solely on your own testimony at the MDR table:
- Lortu psikiatra, garapen pediatra, neuropsikologo edo terapeuta tratatzen ari den zure seme-alabaren larrialdi-gutun bat: eskatu zure medikuari zuzendutako orri bateko gutun bat idazteko gutun-azalera medikoan, estatutu federalaren esaldia zehazki aipatuz. Gutunak diagnostikoa jokabide zehatzarekin lotzen duen mekanismo neurologikoa azaldu behar du (adibidez: "Nire iritzi klinikoan, [Ikaslearen] jokabidea [Data], bereziki ikasgelako materialak bota eta ihes egitea izkin egiten duenean, autismoaren espektroaren nahasteak eta TDAH larriak eragin zuen eta harreman zuzena eta nabarmena izan zuen; gainkarga").
- Erakutsi jarraitutasun historikoa IEP osoan: Ireki zure seme-alabak Portaera Funtzionalaren Ebaluazioen (FBA) eta IEPren Lorpen Akademikoen eta Errendimendu Funtzionaleko Mailen (PLAAFP) iraganean. IEPk berak jadanik ikaslea "erregulazio emozionalarekin, hitzezko ateraldiak zapuztuta dagoenean, inpultsibotasunarekin edo parekoen arteko gatazkarekin" borrokatzen duela deskribatzen badu, adierazi mahai gainean dagoen testu hori: "Zure IEPren dokumentuak ikastetxeak konpondu behar zuen bere ezintasunaren agerpen gisa identifikatzen du portaera zehatz hori."
Zer gertatzen da legez MDR "BAI" denean¶
MDR taldeak BAI erantzuten badio edo 1. atala edo 2. atala:
- Eskolara berehala itzultzea: Ikastetxeak berehala itzuli behar du umea kendu zuten tokira (salbu eta gurasoek eta ikastetxeek beren borondatez adosten badute jokabide-plana aldatzeko lekua aldatzea, edo 45 eguneko Inguruabar Berezien arau estua aplikatzen ez bada).
- Kanporatzea eta epe luzeko etenaldia bertan behera uzten dira: Zehapen-espedientea berehala amaitzen da.
- Derrigorrezko FBA eta BIP: ikasleak ez baditu jadanik Portaera Funtzionalaren Ebaluazioa (FBA) eta Portaeraren Esku-hartze Plana (BIP), eskolak berehala egin beharko du FBA bat eta BIP bat ezarri. Ikasleak dagoeneko BIP bat bazuen, taldeak berrikusi eta aldatu beharko du jokabideari aurre egiteko, eta Prong 2 (inplementatzeko hutsegitea) aurkitzen bada, ikastetxeak berehalako neurriak hartu beharko ditu ezarpen akats horiek konpontzeko.
3. fasea: 45 eguneko "egoera bereziak" salbuespena (armak, drogak, gorputz-lesio larriak)¶
Lege federalaren arabera (34 CFR 300.530(g)) Bat bakarra dago, non ikastetxe batek ikaslea Alternative Educational Settings (IAES) batera eraman dezakeen 45 eskola-egun arte, nahiz eta jokabidea izan bere ezintasunaren agerpen bat izan:
- Arma Arriskutsuak: ikasleak arma bat eramaten du eskolara edo arma bat dauka eskolan, ikastetxeko lokaletan edo ikastetxeko funtzio batean.
- Lege-definizio kritikoa: IDEAren arabera, "arma" 18 U.S.C. 930(g)(2) gailu, tresna, material edo substantzia gisa, heriotza edo gorputz-lesio larriak eragiteko erabiltzen den edo errazteko gai dena, epe horrek EZ du barne hartzen 2,5 hazbeteko (6,35 zentimetro) luzera baino gutxiagoko xafla duen poltsikoko labana bat. Eskolak ohiko 45 eguneko araua deitzen saiatzen dira plastikozko gurin-labanak, guraizeak, arkatzak edo Suitzako Armadako aizto miniaturazkoetarako, eta horietako inork ez du arma arriskutsu baten definizio federala betetzen.
- Legez kanpoko drogak edo substantzia kontrolatuak: ikasleak legez kanpoko drogak jabetu edo erabiltzen ditu, edo kontrolatutako substantzia bat saltzen edo saltzea eskatzen du, eskolan dagoen bitartean. (Ez da aplikatzen legez jabetu eta erabilitako osasun-profesional lizentziadun baten gainbegiratuta dagoen substantzia kontrolatu bati, hala nola ADHD agindutako botikak).
- Gorputz Lesio Larriak (SBI): Ikasleak "gorputz lesio larriak" eragin dizkio beste pertsona bati eskolan zegoela.
- Lege-definizio kritikoa: Ikastetxeko administratzaileak maiz saiatzen dira "Gorputz Lesio Larriak" erreklamatzen disregulatuta dagoen ume batek irakasle bati ostiko bat ematen dionean, besoari hozka egiten dionean edo ubeldura edo marradura bat uzten duenean. 18 urtetik beherako U.S.C. 1365(h)(3) (IDEAn zuzenean onartua), Gorputz Lesio Larriak atalase penal federal izugarri altua du: (A) heriotza-arrisku handia dakarren gorputz-lesioa behar du; (B) muturreko mina fisikoa; (C) desitxuratze luzea eta agerikoa; edo (D) gorputzeko kide baten, organoaren edo adimen-fakultade baten funtzioaren galera edo narriadura luzea (adibidez, garuneko odoljario traumatikoa, organoen funtzio galdua edo ospitaleratzea eskatzen duen haustura larria). Ohiko ubeldurak, marradurak, ziztadak edo larritasun emozionala inoiz ez dira legez IDEAren arabera Gorputzeko Lesio Larritzat hartzen, eta Administrazio Zuzenbideko Epaileek ohiko klausula hau gaizki erabiltzen duten ikastetxeko 45 eguneko kentzeak baliogabetzen dituzte.
4. Fasea: Zer egin ikastetxeak MDR ("EZ"), Duela Prozesu Bizkortua eta Egon Egon bada.¶
MDR batek ez duelako aho batez bozkatu behar eskola barrutiko ordezkariak gurasoen eragozpena gainditzen badu, eskola-administratzaile etsaiek batzuetan "EZ" zigilatzen dute bi adarretatik kanporatze edo eskola alternatiboen transferentziaren bidez bultzatzeko.
Nola errekurritu MDR desegoki bat eta zure seme-alaba eskolan mantendu¶
- MDR erabakitzeko inprimakian "Ados" sinatzeari uko egin: sinatu soilik bilerara zure parte-hartze fisikoa aitortzeko, eta idatzi argi eta garbi zure sinaduraren gainean: "Taldearen erabakiarekin bat ez dut. Jokabidea nire seme-alaben desgaitasunarekin zuzenean lotuta zegoen eta IEP-a ezartzeko barrutiko hutsaren ondorio zuzena izan zen."
- Eskatu Hezkuntza Ebaluazio Independentea (IEE) gastu publikoaren truke: Adierazi erregistroan zure haurraren barrutiko portaera eta ebaluazio psikologikoarekin ados ez zaudela eta formalki eskatu Hezkuntza Ebaluazio Independentea (IEE) (FBA/ebaluazio neuropsikologiko independentea barne) eskola-barrutiak 34 CFR 30.20.
- Eskutatu behar den prozedura bizkortuko audientzia-eskaera berehala: 34 CFR 300.532-ren arabera, MDR erabaki batekin edo diziplina-aldaketaren batekin ados ez dagoen guraso batek Prozesu bizkortuaren audientzia eskatzeko eskubidea du:
- Eskola barrutiak Ebazpen-bilera egin behar du 7 egun naturaleko epean, jakinarazpena jaso eta hurrengo egunetik aurrera.
- 15 egun naturaleko epean ebatzi ezean, **Prozesu Bizkortuaren Audientzia 20 eskola-eguneko epean egin behar da, kexa aurkezten den egunetik zenbatzen hasita, eta administrazio-zuzenbideko epaileak idatzizko erabaki loteslea eman behar du entzunaldiaren ondorengo 10 eskola-eguneko barruan.
- Ulertu "Stay-Put" arauak eta Day-11 FAPE betebeharrak:
- Diziplinarik gabeko IEP-ko gatazketan, Duela Prozesua aurkezteak haurra automatikoki izozten du bere egungo ikasgelan ("Stay-Put" 34 CFR 300.518 pean).
- 34 CFR 300.533 arauaren arabera, diziplina-errekurtso bizkor batean (eskolak "Ez agerraldirik ez" aurkitu edo 45 eguneko araua deitzen duenean), haurra behin-behineko Hezkuntza-Ezarpen Alternatiboan (IAES) geratzen da entzutegiko funtzionarioak erabakia ematen duen arte (gehienez 30 eskola-eguneko guztira) edo diziplina-epea amaitzen den lehenik eta behin adostu gabe, ikastetxeak edozein izanda ere.
- Derrigorrezko Eguneko 11 FAPE Zerbitzuak: MDRa "Bai" ala "Ez" zen kontuan hartu gabe, ikasturte bateko 11. eskola-egun metatua kentzeaz hasita, eskola-barrutiak legez debekatuta dauka hezkuntza bereziko ikasle bat eskolarik gabe etxean eserita uztea. 34 CFR 300.530(d)-ren arabera, eskolak behar du eskaini behar ditu Doako Hezkuntza Publiko Egokiko (FAPE) zerbitzu osoa, haurrari hezkuntza orokorreko curriculumean parte hartzen jarraitzeko eta haurraren IEPan ezarritako helburu guztiak betetzen jarraitzeko. Legez kanpokoa da lan-orri pakete bat sarrerako bulegoan uztea besterik ez; 11. egunean hasita zuzeneko hezkuntza bereziko irakaskuntza eta erlazionatutako zerbitzuak ez emateak Hezkuntza Konpentsatzailea sariak jasotzeko eskubidea ematen dio ikasleari.
5. fasea: oraindik IEPrik ez duten haurrak babestea (34 CFR 300.534)¶
Autismoa, TDAH, dislexia edo asaldura emozionala diagnostikatu gabeko milaka ikasle kanporatze-abisuak jasotzen dituzte eskolak IEPrako ebaluatu aurretik. Lege federalak esplizituki aurreikusten zuen agertoki hau 34 CFR 300.534 ("Haurrentzako babesak ez dira zehaztu hezkuntza berezirako eta erlazionatutako zerbitzuetarako hautagaiak").
Etendura edo kanporatzea aurre egiteko hezkuntza orokorreko ikasle batek berehala aldarrikatu dezake IDEAren babes osoa (MDR baterako kanporatzea geldiaraztea barne), baldin eta eskola-barrutiak "Ezagutza Oinarria" badu, haurra ezintasunen bat duen haur bat zela jokabide-istilua gertatu baino lehen. Lege federalaren arabera, ikastetxeak Ezagutza Oinarri bat duela uste da, baldin eta hiru gauza hauetakoren bat jokabidearen aurretik gertatu bada:
- Gurasoek idatziz adierazitako kezka: haurraren gurasoak kezka adierazi zien idatziz (nahiz eta mezu elektroniko labur bat edo guraso-irakasleen hitzaldi-ohar bat esanez "Kezkatuta nago bere inpultsibotasuna/fokua/hausteengatik eta galdetzen diot probak edo laguntza behar ote duen") ikastetxeko gainbegiratzaile edo administrazioko langileei, edo haurren hezkuntza-zerbitzu berezi bat behar duten eta irakaslearen beharrizanak; EDO
- Gurasoek Ebaluazioa eskatu dute: haurraren gurasoak umearen hezkuntza bereziko ebaluazioa eskatu zuen; EDO
- Eskolako langileek kezka espezifikoak adierazi zituzten: haurrak edo ikastetxeko beste langileak kezka zehatzak adierazi zizkion haurrak zuzenean hezkuntza bereziko zuzendariari edo agentziako gainbegiratze-langileei (adibidez, diziplina-erreferentziak, aholkularien oharrak edo MTSS / RTI maila-interbentzio-mezu elektronikoak).
Zer gertatuko litzateke eskolak aldez aurretik zero 'Ezagutza Oinarria' izango balu?
Nahiz eta hiru gauza horietatik ezer gertatu ez den gertatu aurretik, bidali idatziz idatziz Hezkuntza Bereziko Ebaluazio Osorako Zuzendariari eta Hezkuntza Bereziko Zuzendariari berehala, zure seme-alaba eten dagoen bitartean. 34 CFR 300.534(d)(2) arabera, guraso batek ebaluazioa eskatzen badu haurrak diziplina-neurriak jasaten dituen denbora-aldian, ebaluazioa modu bizkor batean egin behar da. Ebaluazio bizkortuak haurrak IEPrako eskubidea duela baieztatu bezain laster, eskolak berehala eman beharko du FAPE eta IEP lanerako talde bat deitu.
6. Fasea: Legez kanpoko murrizketa, isolamendua eta Eskolako Baliabideen Ofizialaren (SRO) atxiloketak geldiaraztea¶
Desgaitasunen bat duen ikasle batek zentzumen- edo portaera-krisi bat jasaten duenean, prestakuntzarik gabeko langileek batzuetan zoruko murrizketa fisikoarekin erantzuten dute, haurra bakarrik blokeatzen dute "garrasi gela" edo armairu betean edo campuseko polizia bati (Eskolako Baliabideen Ofiziala) deitzen diote 9 urteko haur bati adingabeko zigor-zitazioa eskuburdinak jartzeko edo emateko.
- Murrizketa fisikoa eta isolamenduaren urraketak:
- Egin ezazu berehala zure seme-alabak gorputzaren egiaztapena edozein jokabide-krisiaren ondoren jasotzen duzunean, eskumuturreko ubeldurak, alfonbra-erredurak, petekiak edo ligatze-markak argi distiratsuetan argazkiak atera eta egun berean haurra pediatrarengana edo urgentziazko arreta eramateko, lesioak agiri mediko batean dokumentatzeko.
- Estatu gehienek erabat debekatzen dute egonkortasuna (haurra lurrean ahoz behera edukitzea, eta horrek posizio-asfixia eragiten du), euste mekanikoa, kimikoa eta blokeo itxia; esku-hartze fisikoa ahalbidetzen dute norberari edo besteei kalte fisiko larrien mehatxua dagoenean bakarrik, inoiz ez jabetza suntsitzeari, ez betetzeari edo gela batean sartzeari uko egiteari.
- Eskatu derrigorrezko idatzizko Murrizketa eta Intzidentziaren Gorabeheren Txostena (estatu gehienek ikastetxeek gurasoei 24 orduko epean entregatu behar dietela) eta aurkeztu Estatuko Hezkuntza Departamentuaren kexa eta Eskubide Zibilen Bulegoa (OCR) desgaitasunen diskriminazio salaketa.
- Eskola Baliabideen Ofiziala (SRO) / Adingabeen Erreferentzia Defentsa:

Maiz egiten diren galderak¶
When the school calls me at 11:00 AM asking me to pick up my child early to "help him have a better day" without issuing a formal suspension, does that count toward the 10-day limit?
Yes. Under official guidance from the U.S. Department of Education Office of Special Education and Rehabilitative Services (OSERS), "informal removals", including calling parents to pick a child up early, asking parents to keep a child home for a day to "cool off," or unilaterally shortening the child school day due to behavioral challenges, count as disciplinary removals toward the 10-school-day Change of Placement ceiling. Always reply by email documenting the exact time you were asked to pick your child up so the removal is formally logged on the 10-day clock.
Do In-School Suspensions (ISS) and school bus suspensions count toward the 10 cumulative days of suspension?
Yes, in most cases. An In-School Suspension (ISS) counts as a day of disciplinary removal unless the school proves that while in ISS, your child continued to progress in the general curriculum, received 100 percent of the special education instruction and related services (like speech, OT, or counseling) mandated by their IEP, and participated with non-disabled peers to the same extent as usual. Similarly, a school bus suspension counts as a full day of suspension if transportation is listed as a related service on your child IEP, or if you have no alternative way to get your child to school during the bus ban.
At the Manifestation Determination Review (MDR) meeting, the principal said my child behavior wasn't a manifestation because "he knew right from wrong." Is that legal?
No. Whether a student cognitively "knows right from wrong" is NOT the legal standard under the Individuals with Disabilities Education Act (IDEA). Under 20 U.S.C. 1415(k)(1)(E), the MDR team must answer two specific questions: (1) Was the conduct caused by, or did it have a direct and substantial relationship to, the child disability? or (2) Was the conduct the direct result of the school failure to implement the IEP? A child with ADHD, Autism, Tourette Syndrome, or Emotional Disturbance may understand rules when calm, yet experience neurological executive-function failure or fight-or-flight sensory dysregulation when overstimulated or when staff fail to provide their IEP accommodations.
What happens if my child hits a teacher or throws a chair, can the school automatically move them to an alternative school for 45 days for "Serious Bodily Injury"?
No, unless the injury meets the extreme federal criminal definition of "Serious Bodily Injury" under 18 U.S.C. 1365(h)(3). Under IDEA, a school can only invoke the 45-day Interim Alternative Educational Setting (IAES) injury exception if the student inflicted an injury involving a substantial risk of death, extreme physical pain, protracted and obvious disfigurement, or protracted loss or impairment of a bodily member, organ, or mental faculty. Bruises, scratches, bites, redness, or emotional upset do not legally qualify as Serious Bodily Injury, and if the MDR is a manifestation, the student must be returned to their placement.
My child does not have an IEP or 504 Plan yet, and the school just suspended them and recommended expulsion. Can I still stop the expulsion under special education law?
Often yes. Under 34 CFR 300.534, a student without an IEP is entitled to full IDEA disciplinary protections (including a Manifestation Determination Review) if the school had a "Basis of Knowledge" that the child might have a disability before the incident occurred. You establish Basis of Knowledge by showing a single email or note where you previously told a teacher or administrator you were worried about your child behavior/learning, or by showing that teachers previously documented a pattern of behavioral concerns. Even if there was zero prior record, submit a written request for a Special Education Evaluation immediately today, by law, the school must conduct an expedited evaluation during the suspension period.
What must I do if the school team outvotes me at the MDR meeting and checks "NO" to push through an expulsion?
First, do not sign "Agree" on the MDR form, write clearly above your signature that you dissent from the determination. Second, immediately request an Independent Educational Evaluation (IEE) at public expense. Third, contact a Parent Training and Information Center (PTI), Disability Rights protection and advocacy agency, or special education attorney to file an Expedited Due Process Complaint under 34 CFR 300.532. Filing an expedited appeal forces a resolution meeting within 7 days and an impartial hearing within 20 school days, and starting on Day 11 of any removal, the school is legally required to provide full IEP educational services so your child does not fall behind.
